      Nobscot Dental Care, the ****** of Dr. ******* has failed to provide a copy of the patients full dental records, as required by law.The full dental records were originally requested in writing, at the ******, in June of 2022. After repeated follow **** only a copy of one X-Ray was provided via a portal, instead of the full dental records. Recently, between January and February of 2024, the patient's new dental provider has made over four (4) attempts to get his FULL dental records, but Nobscot Dental Care continues to fail to provide this information and affecting other pending procedures.As noted in Section 1. B. of the ADA ********** of Ethics and Code of Professional Conduct, "patients have the right to see, review, and inspect their record, and to request and obtain a copy of it".       I have not heard from the business in response to my complaint. Nobscot Dental Care, the office of *************************, has failed to provide my FULL dental records timely both to my new provider and myself, the patient, as requested both in person and in writing (signed forms and emails). HIPAA gives patients the right to request 

      A copy of the patient record, including radiographs, shall be provided within a reasonable amount of time not to exceed 30 calendar days from the date of the request - Patient's right (234 *********. 5.13 - Casetext) for both MA and HIPAA

      This is in response to the complaint letter we received on feb 6
      This patient had been unpleasant and not nice to everyone in the office.
      Please see the communication between our office and his new office, that proves radiographs are just what they needed without further need for any other part of the records. 
      No one at all contacted us for those other parts of dental record, as he claimed it was requested 4 times!
      Radiographs are all what we and the rest of other dentists usually ask for and need for comparison.
      However, we will send the other parts of the records to the new office even though they do not need nor asked for it after receiving the radiographs (xrays)

      As noted on the signed form from Nobscot Dental Care, the office of *************************, on July 16, 2022, as per their procedures, the original request was to "provide me with copies of ALL my dental treatment records, including diagnostic x-rays and any other materials, notes, or copies or medications prescribed." Please see attached signed form. This full records is not depending on what the provider believes is best; it's clearly defined in writing.

      Complete records still have not been provided to the patient. A snapshot of the original is included attached showing the mischievous practice by the provider in preventing information from properly and timely being disclosed.

      Worth noting that the request for full dental records and to transfer to a different provider came only after Nobscot Dental, the office of *************************, mixed files and incorrectly called a different patient instead of me after leaving a message for an emergency. The office failed to addressed this HIPPA issue saying this was relatively normal from their employees.

      The file attached in the the response from Nobscot Dental Care, the office of *************************, appears unprofessional, defensive, and excusing the fact that the FULL dental records requested back on July 16, 2022 in writing (both in the form signed at their office and then via email) and also via phone were not provided to the patient and the gaps in their procedures. As a patient, I still don't have access to any of my dental records during the 5+ years receiving treatments there. Simply put, this is a patient's right.

      Separate from that, records were only transferred to the new provider once this claim was filed. No action had been taken prior to that by Nobscot Dental Care, the office of *************************, similar to the lack of action following the request on July 16, 2022 and follow ups.

      Both emphasize the mischievous practice and internal gaps.
