Contractor hired to build a 2 car garage for $116,655.00 Contractor requested 50% of funds up front, ($58,328.00) which I paid on March 25th. No items were special order items. Second payment was of 20% ($23,331.00) due after foundation and back fill ($29,163.00 which is 25% in correct calculating on contract), I requested a change in second payment on May 2, 2022 due to there was absolutely no proof of any orders of lumber, doors, windows, garage doors, siding, etc. after requesting proof. On May 4, 2022 Contractor rejected the request. On May 5, 2022 requested a different change of proposal. On May 7, 2022 Contractor and I had a verbal agreement and I issued a check in the amount of $18,700.00. The Contractor took and cashed this check. At this time the Contractor had $77,028 and the only thing that was done was the foundation and back fill. I had no proof of any orders of any supplies and or stock. The Contractor had 2/3 of the total contract. Partial lumber order was delivered on May 13, 2022. With many text and email back an forth. on 5/25/22 the Contractor wanted more money which was not due. Contractor stated that all work would stop if he did not receive the amount on the original contract. Contractor told the framers to leave at 1:30 pm that day and would not return. I at that point terminated him off the permit.At this point, I was missing partial order from ******** Lumber, no doors, no windows, no garage doors, no siding, no roofing. I was left with some lumber. Any assistance would be appreciated.
