March 2022 *****************, Lone Pine Painting, agreed to quote an exterior house painting job at my residence of 13 ****************. *********** **.Job included, site prep, rotten wood repair/replacement, and finish paint job.Date of transaction: April 20th, check was cashed. May 4th, deposit of $500 was confirmed received by **** via text.What the business committed to provide me: I have a copy of the contract with committed work and copy of check stub of cashed deposit check.What the nature of the dispute is:September 2022; When it came time to do the work **** wanted to finish paint the house without repairing any of the wood. He said he would have his contractor come back later to repair the rotten wood and he would clean up any repair areas as needed.This is not what we had agreed to. I asked to have the rotten wood repaired before we paint the house with a spray gun. ***** reply I am at the end of my line with home owners telling me how to do my job. If you cant let me do the job in a way that fits my schedule you will need to find someone else. Then hung up on me.Conversation moved to text when I followed up with him saying that was unprofessional and asked for my deposit back. He said the deposit was non-refundable, despite him quitting before the job even began.**** has ignored me with no attempt to resolve.Business response

Hello in response to *************** complaintHe gave me a fraction of the contract deposit amount to hold his place on my very busy 2022 schedule. He told me I had to wait for the new windows were installed. I was finally notified late in the season that the windows were in and I could start work when I was ready. I planned ahead and set aside a 2 week time slot to complete the job I notified the homeowner on a Saturday that I would be there to start the job first thing Monday morning that week.He mentioned replacing the rotted wood which I explained would happen during week 2 of the job when my uncle was available to do it. **** stated "oh if your uncle can't come until the following week just schedule the job to start then so the wood repair can be done before anything else.
I explained that the wood replacement can take place at anytime during the job and that the replacement wood would be painted before it was installed then nail holes touched up after it was installed and that the entire job as outlined in the contract would be completed in the designated 2 week time frame. The homeowner had a fit and insisted that the wood replacement had to be the first thing that was done on the Job. I explained that it wouldn't matter when the wood was replaced and that my uncle would be there to take care of it by Wednesday of week 2 I explained that this 2 weeks is the time slot that he reserved with his deposit and he chose to prevent me from starting the job based on above reason. 2 weeks in my schedule was wasted
