I have attached the letter that was sent to *** ***** that was
accompanied by a check for $1000. I have copied the text of the letter
below which explains the situation and how I was never fully retained
on this case. I have closed the file and issued a refund of the
partial refund that was being held by my office.

      *** *****:

You made a partial payment towards my representation to probate the
estate of ******* ***** in September 2021. Unfortunately, you have
never signed a written fee agreement with my office to lay out costs
and terms of my representation. I cannot represent a client without a
fee agreement in place. You have also not paid the full retainer
amount of $1500.00 to secure my representation. I am not willing to
handle this case without receiving a full retainer. I have also not
been able to reach you despite multiple phone calls. I am not willing
to wait any longer, and therefore, I am returning the partial retainer
that you paid of $1000.00, along with any original documents that were
being held by my office while waiting for you to make the full
retainer payment. I wish you good luck in the future.

      Customer response

      06/17/2022

Brian is pretending like he couldn't reach me, of the 20+ requests for a call back over the course of a year. He did not call the correct number, I gave clear instructions for where to call to his secretary.

I also sent him an email, and doesn't want to respond there either. He has had numerous similar complaints from other clients on review websites. A significant amount of reviews complain that clients do not receive any response after payment. I've sent all paper work he has asked for.

He also sent the check to the wrong address. If he had the will and professionalism to be able to perform basic communication via email or return a calls to the appropriate number then we could have easily coordinated what he needed to complete the job. Or in this case receive a refund check to the appropriate mailing address.

A year has passed without communication, and as people do sometimes after long periods of time, I have moved.

      My current address:

      *** * ***** ***

      ******* ** *****

I'm afraid I can't accept any outcome until I have the check in hand, his inability to communicate makes the simplest tasks impossible.

I am rejecting this response because:

      Sincerely,

My office was never retained by *** *****. A step was taken towards
retaining my services by *** ***** when he made a partial payment
towards a retainer. A Retainer Agreement was never signed by ***
*****. The remainder retainer payment was never made by *** *****. The
partial payment he made was held in escrow while waiting for the full
payment amount. A full retainer payment is needed before work starts
on a case. He never made the full retainer payment amount so all the
money he had paid that was held in escrow was returned to him via
      mailing of a check.
