  We had a roof installed on our house not quite a year ago, We recently had work done on the chimney and while it was being done the person putting up the flashing noticed the shingles were cracked and the flat roof had bubbling, At this time the people did an inspection and documented it, I have tried numerous times to contact the builder to correct the problem, He said he would get back with me but has not, I am seeking ****** for the return of the roof as I need a whole new roof put on,,

  To whom it may concern, 
  On March 16, 2023 ***** ******* hired Levi Smith Construction LLC to remove an existing exterior door and frame. After the removal, to install a new exterior door and door k*** with the home owner to purchase the new door and door k*** Which is a total labor only cost of $225.00. The same day, Levi Smith Construction LLC was hired to install a new door k*** and weather seal on the front door & to adjust the storm door. The home owner responsible to purchase the materials for a total labor only cost of $125.00. The haul away of debris totally $35.00. The home owner was informed that the door size is 32 standard height with a lefthand in-swing. The total amount of this contract $385.00. 
  The home owner was satisfied with the work which resulted in another contract that began on April 4, 2023. This specific contract includes the removal of existing shingles, under payment, drip edge and the roof flashing. After the removal, the installation of new white drip edge, ice and water guard on *****, valley and flashing areas. The installation of felt on the remaining area of the roof, with rubber roofing installed in the flat areas and tan Atlas shingles installed on all other areas of the roof. This contract includes the removal and haul away of all debris. The total amount of this contract including labor and materials is $16,400.00. The customer was informed that any bad wood is not included in this specific contract. The proposal to complete this contract is that 50% down to begin, 25% due when the job is halfway done and the remaining 25% to be paid on completion of the job. This job was completed on January 6, 2024. 
  The home owner was satisfied with the work which resulted in another contract that began on April 10, 2023. This specific contract included the installation of 7/16 OSB inside of the garage walls only, skim coat seams with drywall mud and finish with a coat of white paint. The total of this contract with labor and materials is $1,485.00. The home owner was notified that if a second coat of paint would be needed that it would cost an additional $335.00. The proposal to complete the contract is 50% down to begin then 25% when the job is halfway complete and the final 25% due at the completion of the work. Another contract that also began on April 10, 2023 is to install new white soffit and facia around the entire home, wrap the brick with freeze board and then in aluminum wrapping. Also to install new 5 white gutter on the entire home. The total of this specific contract including labor and materials is $8, 865.00. The proposal to complete this contract is 50% down to begin, 25% when the job is halfway complete and the remaining 25% when the job is completed. 
  On October 18, 2024, Levi Smith Construction LLC was served by **** ********* ************** in regard to ***** ******* and her mother ***** ******* due to them stating that the contract for the roof was started on April 4, 2003 which is incorrect, the roof contract began on April 4, 2023. The home owner is also stating that the wrong flashing was installed due to needing new flashing after having ***** and Sons to do the chimney. ******************* told the home owner that they do not install flashing that she would need to hire another contractor to install the flashing. ******************* is a masonry contractor whom does not install flashing, so they do not having the knowledge or education to determine if flashing needed replacing. The home owner then states that she hired Michigan Sealed Exteriors to do the flashing, which resulted in Michigan Sealed Exteriors telling the home owner that she had problems on the roof. The home owner, later stating that ************************* stated it looked bad. The home owner stating that she hired an inspector on October 16, 2024 for $350.00 with no outcome from the inspector or who the inspector is. 
  On Saturday, September 28, 2024 ***** (***** ******* mother) reached out to Levi Smith Construction LLC stating I have some issues going on on the roof. Levi Smith Construction LLC responded on Monday, September 30, 2024 Sorry for the late reply but Im not in the area until end of next week, but I will address your concerns. Thanks. ***** then replied stating Okay thanks. Beginning on October 6, 2024 ***** continuously texted Levi Smith Construction LLC, Do you know when you will be coming by?,  On October 7, ***************** a call., and on October 8, 2024 Are you available for me to call you. This was after, Levi Smith Construction LLC already informed ***** that he would not be available until the end of that week, which would be October 10th or 11th. 
  On October 10, 2024 ***** ******* reached out the BBB stating that she had work done on the chimney and the while it was being done the person putting up the flashing noticed the shingles were cracked and the flat roof had bubbling, At this time the people did an inspection and documented it, I have tried numerous times to contact the builder to correct the problem, He said he would get back with me but has not, I am seeking 14, 300 for the return of the roof as I need a whole new roof put on, ,
  The warranty that was valid for the installation of the roof is now null and void since ***** ******* and ***** ******* had another contractor on the roof to deal with the problems on the roof. ***** never gave Levi Smith Construction LLC the details of what problems she was enduring nor allowed him to come and look to be able to resolve any issues under warranty. Any contractor is able to have their own opinion on what the final project should look like; this does not mean that the final product was incorrect. I do not know what Michigan Sealed Exteriors, or ***** and Sons did while they were there. After Levi Smith Construction LLC completed the roof, a video was taken and played to ***** ******* so she was able to see the finished roof. ***** was satisfied with the end results. The proper flashing was used in all areas that flashing is needed by installing the step flashing with a counter flash. The flashing was also grooved and bent into the chimney then sealed the seam. ***** or ***** never reached out to the Levi Smith Construction LLC with any concerns or issues with the roof until they had other contractors on the roof. Once another contractor completes work, I am no longer held liable for the issues.

  I do agree **** Smith did other work for us and we are not disputing that.  However, it took him from 4/4 23 until 1/6/24.  No one has touched the roof except to get an inspection.  The chimney is at the front of the house and all of the problems are at the back.  We dd have someone come out to do the flashing on the chimney and out of the corner of his eye he seen nails sticking out.  At that time, he told us we have issues on the roof.  I immediately called Levi ***************************** He never called or gave me a time he would come out to answer our concerns.  I then contacted an inspector to come and let us know what the problems were.  So he never spoke to us or gave us a time he would come out.  Therefore, I am taking legal action.  Thank you for your time, Sincerely ***** ******* and ***** *******.  11/4/2024
