In July of 2022 I hired ****** Maynard from Maynard Contracting to install 8 windows in my home for a total of $8,945. On August 24th I paid ****** $4,500 cash. ****** came to my house on Oct. 18th and dropped off 8 windows and completed no work. That evening I spoke to ******, who stated 5 of the windows were 1 1/2inch too small. ****** claimed this was a mess up on the lumber company, but they would not fix it. ****** assured me that he could install the windows and make them correct. I informed ****** that the largest 2 windows were not at all what I had order. I even sent a picture of the windows that I wanted installed. ****** claimed he miss understood me and that's what I was stuck with. ****** came back on Oct 20th and installed 3 windows in which he did not complete any of the work. ****** then came on Oct. 21st and installed 2 more windows in which he did not complete any of the work. One of the windows he installed on this day was one of the biggest windows. This particular window was originally 5ft tall by 7ft wide and was supposed to be downsized to 4ft tall by 6ft wide. ****** knew this based on the picture I sent him and the conversation we had at my home. ****** thus installed a window that was 6ft tall by 4 ft wide. On this same day, ****** took 2 of the windows with him because they were the wrong size. ****** has not refunded my money for these 2 windows, nor has he replaced them with the correct sized windows.

      to me

Hi ********, after the windows were installed ******* agreed and said the windows looked good, I have that in text, however also the windows were at her house for 3 days and she had plenty of time to look at them and she told me that she did like the windows. I installed all the windows and they turned out great, I never was paid for any of my labor I was there for 2 days. So I’m a little confused on why I would refund her. She agreed on the windows and liked them. I have also in text she wanted the windows 4x6 and that’s what she got. Also she did send me a picture of a bay window which was also never discussed and now all of sudden she wanted bay windows installed. What she did was sent me a picture of the bay window and said I the grid in the windows is all, she never once stated that she wanted bay windows. If that was the case then her home would’ve had to have additional framing done which was also never  discussed. Thanks for your time, ******

      Complaint: ********

I am rejecting this response because: ******'s response is not accurate or true. First and foremost, you will find the attachment titled "Maynard" which is our entire conversation. You may note that I never said, "the windows look good" during any of our conversation. Looking at attachment titled "Maynard" Oct 18th t 4:55PM you can see I text ****** "what's going" and he responded, "I will call you." During this phone conversation when ****** called, he informed me "the lumber company messed up the size of the windows and assured me he could make them look right." Please note his next text on Oct 19th at 7:06 which clearly indicates there was something wrong, ****** stating " we can install them and I assure you that they will look great thats what I can offer you." Please see attachment Window 8 and attachment window 6 to view ******s "great" work or lack thereof.

In reference to the incorrect size of the living room windows, please refer to our conversation beginning August 9th at 7:17PM where I sent a picture of the desired window I was looking for. Please refer to attachment "Big window 2 after" to see that ****** installed a window that did not resemble the picture I sent him in Maynard conversation nor was this window completed.

The "Maynard" attachment will indicate that on Aug 2nd at 9:31 ****** quoted me $5960 as the original quote. August 3rd, I began inquiring about Window options. On August 9th I sent ****** a photo of the Window I wanted and he gave me a new quote on August 23rd 7:47 pm of $8945 to include the new windows that I wanted.

I have attached photos, Window 2 ,5, 6, 7, 8, 10, 11, and Big window 2, that show ******'s incomplete work. Our detailed conversation on August 3rd at 7:49 Am indicates ******'s quote includes all of labor to be inside and outside.

Please see attachment Invoice, that indicates 8 windows were to be installed. ****** did not install 8 windows and took the 2 upstairs windows from my home. I request a full refund from ******.

      Sincerely,

      ******* ****

I refuse to refund ******* any money. I installed the windows in *******s home and have not been paid for any of the work I’ve done like *******  said she would. I installed3 the first day I worked at *******s home and the next day I installed 2 windows and I asked to be paid something and ******* never paid me anything. ******* doesn’t actually state that the windows look good but I sent her a picture and she sent a thumbs up back agreeing and liking the windows. If ******* didn’t like the windows she would have she would’ve said something or sent a thumbs down not agreeing to liking the windows. ******* states that the windows are 1 1/2” off and that is incorrect . I delivered the windows to *******s house and they were for 3 days and she never once mentioned to me that she didn’t like the windows until they were installed and there was nothing we could since these were special ordered windows. ******* states that she wanted bay windows which was never discussed between us, she sent me a picture of a bay window and all she said was she likes the grids that were in the windows never once mentions that she wanted bay windows. As you can see in the pictures I installed brand new windows in her home and have not been compensated at all for my time. I have the other two windows for the upstairs I held onto them because I was never paid anything for my work that has been completed. The windows do no leak as I tested them the days I installed them. I will deliver the 2 windows for the upstairs but will not do any work for *******.

      Complaint: ********

I am rejecting this response because: ****** did not complete any of the work he started in my home. He was there for two days and did install 5 windows however, he did not finish any of those 5 windows. ****** is responsible for incorrectly measuring the windows which is why they were all the wrong size to begin with. ****** assured me, he would make them all look right. As you can see in the pictures, he did not do that. Both windows installed on my porch were never trimmed correctly on the inside. One of the porch windows is still missing trim on the outside. The smaller window installed in the living room has siding missing from the outside and the drywall is not finished on the inside. The large window in the living room is completely wrong. The window was supposed to be 4ft tall by 6 ft wide. ****** installed a 6ft tall by 4ft wide window. He knew this was supposed to be 4x6 because he measured them and I explained to him that I wanted both windows to be the same height and to have more privacy from the road, not less. Furthermore, ****** did not even complete the work on the window he did install. I currently have to fill in gaps with Towels, so wind, rain and snow don't blow through. Additionally, he did not complete the drywall work or trim on this window either. I did send pictures of a bay window that I wanted with Grids. I sent a picture of exactly what I wanted, and ****** gave me an updated quote to include that. This is seen in our conversation. The window ****** installed in the bedroom was also not completed. Pictures show gaps nearly an inch wide where I have had to again fill with towels to keep weather out. Likewise, the trim inside and out was not finished either. As for the two upstairs windows, I would like my money back. ****** also measured those windows incorrectly, which is why he took them. He told me he was going to take them back to the lumber company to see what they would do because he wasn't going to be able to install them because they were nowhere near the same size as my current windows.  I do not want ****** to do any work in my home.

      Sincerely,

      ******* ****
