Government Action: BBB reports on known government actions involving business’ marketplace conduct:

United States vs Diesel Ops, LLC et al. Case# 2:21-cv-12928

On August 29, 2022, the U.S. District Court in the Eastern District of Michigan awarded a default judgment, granting $10 million civil penalty against Diesel Ops, LLC and Orion Diesel LLC. The court also granted a civil penalty of $455,925 against the owner, Nicholas Piccolo, for his failure to respond to an information issued pursuant to Section 208 of the Clean Air Act, and entered a judgment against Piccolo of $979,818 for alleged fraudulent transfers from Diesel Ops LLC to Piccolo in violation of the Federal Debt Collection Procedures Act. 

The default judgment settles a December 2021 complaint filed by the Department of Justice on behalf of the Environmental Protection Agency (EPA). The complaint alleged the manufacture, sale, and installation of aftermarket parts, known as "defeat devices", designed to bypass, defeat, or disable required vehicle emissions controls. It further alleged that Mr. Piccolo failed to respond to the EEPA's request for information regarding any products sold, and that assets were transferred from Diesel Ops LLC to Piccolo after the EPA's notice of the potential penalties for violating the Clean Air Act.
