      In October of 2021 we hired ***************** to erect an RVport over our camper at ******************* lake. He quoted ** $4800. We paid him $3,000 down and the remainder due upon completion. He then asked us for an additional $900 which we gave him which left us with a balance of $900 due upon completion. Today is May 16, 2022 and the project is still not completed. We have heard every excuse possible from lack of helpers, to weather, to someone having to travel out west to father in law in ICU. We have threatened legal action of which he begged us not to do and said it would destroy his family. We left our RV out in the fall thinking this work would be completed. He kept assuring us it would be. So it ended up sitting out all winter. It's sitting in another spot at the campsite so that the work could be completed on ours. He is now preventing our landlord from renting the spot our camper is in because he isn't done with the work on our original spot.. Two spots are being taken up because of his lack of follow through and only rent on one being collected. I have all the text messages back and forth documenting all of the exchanges between us including every excuse. Six months is MORE THAN ENOUGH TIME to complete an RV port and we just want the work done to code in a timely manner or our $3900 back so we can hire a real contractor.

      I entered into a written contract on 11-2-20 with Mr. **** to construct a metal pole barn/shed on our property. Full amount of contract was for $27,300 which included all labor and materials. I paid Mr. **** $13,650 at signing of the contract to start construction. On 11-18-2, Mr. **** requested a second payment of $6,825 (which we paid) for purchase of the metal material that would be needed for roof and sides of building. On 1-8-21, Mr. **** advised that the metal had been purchased but he needed to purchase gravel and concrete prior to installing the metal and he requested another draw of $3412.50 (which we paid) for purchase of those materials. Mr. **** advised that he had several jobs going on at the same time and was working ours in amongst those other jobs but would complete our job within a couple of weeks. After that date, we had a very difficult time contacting Mr. **** and when we were able to contact him, he always had an excuse as to why he could not work that week (i.e. car problems, doctors appt, labor shortage, weather, etc). I have numerous text messages from him advising that he was coming to work the next day but he never would show up. I have sent him certified letters asking for our money back and to return our keys to the property but he has not responded. I have threatened legal action and have just found out that another party is suing him for the exact same issues that we are having with him. Mr. **** has advised several times that he is in possession of the material that we have already paid for, but every time I have asked for him to deliver it to the job site or allow me to pick it up, he does not reply back. I am asking for any assistance that BBB can give to help us with this situation as well as make sure that others know of his business practices so that they do not get scammed like me. We have since hired another contractor to fix the faulty building issues that Mr. **** had, but still have no metal installed.

      I am rejecting this response because:

      Mr **** has made multiple commitments to finish the job and has never shown up as promised.  I have multiple text messages from him advising that he is coming to finish job but he never shows up.  He has given multiple excuses including car broke down, workers not available, weather, etc.  I have asked him to deliver the job materials to the job site or allow me to pick them up but but he will not respond.  He is currently being sued in Clark County MO circuit court for breach of contract by doing the same thing that he has done to me.  I had to hire another contractor to pour the concrete floor that he failed to install. I have purchased the metal material that he has failed to deliver and install. He has no intentions to finish this job and has taken my money.
