      Triton Exteriors was contracted to replace the shingle roof on our home. The work was completed in November 2019. Following the work by Triton, we contracted siding work through another company, in 2020. Following a heavy storm, in late summer 2020, we started to notice water leaks inside the house. Initial contact was made to the siding company, who immediately remedied several items. The next instance of very heavy wind-driven rain was in May 2022. Water leaks at that time were significant. Based on subsequent inspection, it became clear that these leaks were roofing related. Triton was contacted. *** ****** (********* ** ******) sent one of his employees to look at the roof issues. They subsequently disavowed any responsibility and blamed all issues on the siding contractor, even roofing issues that were not in the area where the siding contractor worked. Following multiple contacts, *** finally agreed to come to the house on August 5th, 2022. Unfortunately, when he arrived, he launched into a totally unprofessional expletive laced tirade. He refused to get on the roof to look at issues and emphatically refused to assist with the assessment and/or remedy of any of the identified existing roofing issues. These included; 1) Broken Shingles; 2) Exposed Nails; 3) Flashing Issues; 4) Roof Penetrations; 5) Missing Shingle; and, 6) Broken J-Channel. Since Triton was in Material Breach of its Warranty Obligations and refused all assistance, I was forced to act, in order to mitigate further damage to my home. Triton has refused to respond to attempts to remedy the issue. I am claiming expenses for repairing the roof, interior water damage and my time to date ($1,115 + $1,085 + $1,155). The total current claim against Triton is $3,355. I also want other potential customers to know that Triton is an unreputable contractor who refuses to honor their contractual warranty obligations, even when presented with clear evidence of deficient workmanship.

      We understand how frustrated you must be that your home is leaking! Unfortunately, as you stated in multiple review forums: “Following the work by Triton, we contracted siding work through another company, in 2020. Following a heavy storm, in late summer 2020, we started to notice water leaks inside the house.” 


      Since you contacted us about your roof we installed 4 years ago, we have spoken to you numerous times on the phone, been to your home twice and met with your new exterior contractor ******* We do not deny there was a problem with your home, we agree with you. We were happy to spend time examining your roof and showing you and ****** why the work installed after our work is causing your home to leak. We did not install the new work on your home. As much as we would like to, we can not warranty another company's work. We wish there was more we could do for you which is why we continued to communicate with you and have onsite meetings after we examined and identified the incorrect installation on your home.

      You stated in your response that “Triton's response does not address the complaint” and that Tim stated Triton “would not lift a finger” to address the leaking roof. 
      Per you, there were 1) Broken Shingles; 2) Exposed Nails; 3) Flashing Issues; 4) Roof Penetrations; 5) Missing Shingle; and 6) Broken J-Channel.


      We know this to be true because our repair manager and the owner of the company (Tim) came to your home and met with your contractor. The Broken Shingle, Flashing issues, Missing Shingle, and broken J-channel damage were created by a different contractor while working on your home. We are not sure what you are referencing as Roof penetrations but we believe it was the nail pop (a roofing nail that had come from underneath the shingle and popped out the top of the shingle). 


      We agreed that the exposed nail and shingle with a nail pop was Triton's responsibility. Triton sent you a check for $250 for you to have your new contractor repair those 2 items. 
      You had Triton give you an estimate for the additional work done on your home. You chose another contractor. Unfortunately, that contractor did inferior work and damaged the work we performed on your home which voided your warranty. 


      Even with your warranty voided, we have met with you multiple times and sent you a check. We simply can not warranty work performed by another contractor that damaged your home.

      I am rejecting this response because:

      Triton is falsely attempting to blame someone else for Triton's deficient work.  Specifically,

      1) Triton did NOT meet with our siding contractor.  Instead, Tim, stood on the side walk and launched into and expletive laced tirade and explicitly and profanely refused to honor his contractual warranty for work that Triton executed.  Tim's behavior that day was the most unprofessional that I have ever experienced by a contractor.

      2) Work completed by the siding contractor has no bearing whatsoever with the deficient roofing work provided by Triton.

      3) The broken J-Channel is not even remotely close to any work done by the siding contractor.  Hence, the damage could only have been caused by Triton.  Triton has refused to honor their warranty obligations to correct this.

      4) The poor workmanship around the roof penetrations is solely a roofing issue and has no bearing whatsoever to any siding work, which may have been done.  Triton has refused to honor their warranty obligations to correct these issues.

      5) The missing shingle is in front of a dormer and is solely a roofing issue.  Triton has refused to honor their warranty obligations to correct this.

      6) There were multiple issues related to exposed nail heads.  And, while Triton did offer a token amount (insufficient to correct the issues), the check that they issued included the phrase "Full and Final Payment."  This means that, if I had accepted it, I would no longer be able to seek remedy for any of the other issues.  Hence, the insufficient offer was rejected.

      7) Broken shingles in valleys is solely a roofing issue - due to incorrect installation.  Triton has refused to honor their warranty obligations to correct this.

      8) Triton has no contractual basis for supposedly 'voiding' their warranty.  And, it is telling that they have not claimed a contractual basis.  Most probably, since none exists.

      Triton remains in Material Breach of their Contractual Warranty Obligations and my claim stands as submitted.

      We have responded to 6 review complaints across the internet. We have had meetings on site. We have not run from or ignored any communication. The home did not have any challenges until work was completed by another contractor. Unfortunately, as stated in multiple review forums: “Following the work by Triton, we contracted siding work through another company, in 2020. Following a heavy storm, in late summer 2020, we started to notice water leaks inside the house.” To install the work the new contractor had to walk all over our work and removed siding that covered the roofing flashing. 

      On separate occasions we have sent out employees and even mailed a check for work we did feel could be our fault. We did not install the new work on your home. As much as we would like to, we can not warranty another company's work. We wish there was more we could do for you which is why we continued to communicate with you and have onsite meetings after we examined and identified the incorrect installation on your home.

      I am rejecting this response because:

      Triton's statements continue to be nonresponsive to the issues.  For example, as has been repeatedly discussed with Triton, walking on shingles does not damage them.  I am not asking Triton to warranty the work of another company.  I am asked Triton to warranty their work, as they are contractually obligated to do.

      While Triton does continues to 'communicate,' their communications are only obfuscations.  Triton has done absolutely nothing to assist with the issues of water leaks.  They have NOT 'examined' -- nor, have I asked them to -- the work of others.  And, Triton has not identified incorrect installation work by others on my home.  On the contrary, when presented with evidence of incorrect roofing installation, Triton blames others and refuses to help.

      I am only seeking for Triton the honor their contractual warranty obligations.  Unfortunately, they continue to be in MATERIAL BREACH OF CONTRACT.  And, unfortunately, the leaks continue, with no assistance from Triton, regarding resolution.  Since the leaks continue (more this past weekend during the storm on Saturday evening, April 15th), I will likely need to amend the claim.
