We placed a non-refundable $67,000 downpayment for a modular home for my mother, who was diagnosed with a rapid form of dementia last spring, on July 23, 2022 with the promise of delivery of the home to our property in 8-10 weeks. The balance of $213,000 was paid in full on October 24, 2022, after some back and forth regarding their ability to deliver the home by Nov 1 or 2. In the end, the home took 5 months to be delivered, arriving on December 9. The home is currently incomplete and the company will not answer emails to address the work still needed. Among other things, the foundation which cost us an additional $40,000 from this company, is exposed, which according to manufacturer specifications is now in danger of deterioration because it has not been properly covered in the recommended time frame. I had initially found a contractor to do this work at a lower cost but the owner of Lovejoy threatened us if the job wasn't done by Lovejoy Homes. Following is the list I have sent them three times in the last few weeks: • exterior finishing of foundation • dryer vent — not installed in laundry room • no drain pan on the water heater—not up to code • crawl space vents installed • gutters installed • A/C unit installed • siding installation finished • replace damaged trim piece on roof • bathroom wall • utility room door • itemized HVAC price list and receipt to submit for rebate • final inspection — process for closing • warranty • keys? My mother is declining fast and my parents need to be moved into this home now. This company has lied and stonewalled us from the moment we paid them a non-refundable downpayment. The owner has screamed at me on the phone multiple times when I have asked for information. I have given them a date of January 20 to be finished or allow me to hire contractors to finish the job and have bills reimbursed by them. They are holding my family hostage and we simply do not have the luxury of time to wait.Business response

If in fact, we promised her 8-10 weeks, which is an approximation, that delivery date would have been mid Oct. The home was going to be delayed, due to supply chain issues at the factory at which time, she was notified of the delay.
She changed the order many times and was at some point going to cancel the order. If we order a home and it is in production, we do not refund the house, as a matter of fact, at one point she was not going to take the home and we waited two weeks for a decision if Lovejoy was doing her crawl space or her contractor.
Her contractor was in fact, quite a bit less money than we were but when she compared bids, her contractor’s bid did not include everything that our bid did, which is relevant because I explained to her (NO THREAT was made as she states) that if the foundation work is not done correctly, then Lovejoy cannot install the home on the foundation. WE are regulated by State laws, and we absolutely cannot set a home on a foundation that is not done correctly.
When she stated that she might not go through with the purchase, after she changed her mind several times, I felt uncomfortable authorizing production unless she paid in full, which she did not do until October 24th. She was told on October 19th that we had to be paid in full and she stalled for 5 days.
She still wanted to make changes, as late as October 19th but the factory would not make the changes that late in the process.
The November timeline had changed already at that point as she was well aware of.
Unfortunately, the factory told us that we would get it the middle of November and for some reason they had to close the plant for two weeks, which made me very upset and delayed the production. But this was beyond my control, and I assume it was due to supply change issuers or Covid issues. I never got a complete answer from the factory other than they had to shut down.
Still at that point we got the house on December 9th, prepared it for installation and set it on the foundation on December 12th.
We have had very inclement weather, lots of rain on the job site, -35-degree windchill, 30 mph+ winds, and holidays, all that affect our materials and our crews.
I will now address her “unfinished issues” All of the following have been very explicitly explained to her, and or her husband in writing and verbally:
Exterior finish of the foundation- WE cannot complete this until the temperature is warmer per the materials makers installation guidelines There is no requirement per manufacture for this to be done immediately, sometimes per supplier statement it does not get done for 6 months, which does not hurt anything, it just has to be applied differently if you wait that long, we hope to finish it as soon as weather permits.
Dryer Vent not installed in the laundry room- this is a factory issue. She changed the location of the washer and dryer, so they did not cut a hole in the floor for it, but the vent itself is up to the homeowner to install as there is no way the factory would know where to place it.
The factory has been informed and they will be dealing with it, we are staying out of the middle of any factory issues.
The drain pan is not installed on the water heater- IN fact it is installed, the factory takes pictures of the house before shipment, and it is installed.
We showed her husband yesterday. It is up to the homeowner to plumb it out through the foundation as they elected to do all of their own plumbing work against our advice, but we cannot force anyone to let us do it, just like I did not force her to do the foundation, I just highly recommend it.
Crawl space vents not installed- As she has been repeatedly told, this will be done when we put the sealant material on the foundation. Otherwise, we would have sealant all over the vents.
Gutter not installed- The guttering has in fact been installed, last weekend
A/C unit not installed – A/C unit was delivered Monday, compressor is there, and A-coil is installed, but due to the fact that they flooded the crawl space, it could not be hooked up, We hope it dries out enough to do by Friday.
Exterior finish of siding- we did not have enough materials sent from the factory to complete this. We are short approximately 4 pieces which have been backordered/delayed. We expect to have it next week and finish as well as take care of the trim piece on the roof at the same time
Bathroom Wall- the factory did not put a wall in as the customer wanted, as a courtesy we decided to take care of this for her, but anything like that has to be approved by the factory and authorized. We in fact built the wall and had to let it dry(sheet rock texture) WE went back to finish it, a specialist driving two hours and we was not able to finish it because they were putting tile in that room and we could not access it. Wasted 4 hours driving time. WE went back yesterday and finished it. We have completed all the interior work.
Utility room door- There is a utility room door there. It has a cold air return vent in it, which she does not like. She demanded that I change it but that could affect the warranty on her furnace as well as take the house out of code compliance. Due to this issue, I cannot violate the building codes, not for anybody. I did agree to get her a plain door and she can do whatever she wants to do. This is a courtesy, however, I had to special order it, and it is being shipped with the siding mentioned above. As soon as I receive it, I will go finish the siding and give her the door.
HVAC Price list- She has had this for quite a while, it is not specific enough for her but that is all that I could get from the factory.
Final inspection- She has inspected every inch of this house from day 1, I guess when we put the last piece of siding on she can look at it?
Process for Closing- I do not understand what she means by this, she paid for the house up front, she took possession of the house and started inside work on or about the 15th of December. There is no final closing that I am involved with.
Warranty- All warranty information has to stay in the house (in other words I do not ever have possession of it) It should have been in the cabinets of the house but she had a contractor rip out all the cabinets. On the 17th of January she told my contractor that she found the homeowners packet and all the warranty information, so we never did have it. BUT she does.
Keys- WE gave her all keys on the 17th
To finish the last of her letter, WE have been very transparent with her as we are with everyone.
Covid has caused a lot of supply chain issues which have been very hard to deal with and we have had to be up front and upset a lot of people, BUT 99.9% of them understand that it is just the times we have been living in. MY point is we have sold many houses and we are absolutely upfront with clients no matter how hard it is to tell them that the building of their house has been delayed or the price dramatically increased, but not a single customer has opted out of an order and cancelled. They have that option up to a certain time.
WE have been in this business since 1958, 65 years, and I have been doing this since 1989 I bought the company from my mom and dad in 1996. We never lie to our customers. As I addressed earlier, We cannot refund a customer after production starts.
As far as her saying I screamed at her, I was on speaker phone, my staff was all there, she would not let me answer her questions and started talking over me, as I tried to talk to her about when we would finish. I talked very loudly and told her if she did not let me talk that I would just end the conversation and hang up, (I was not screaming) and then her husband took over the conversation.
I am not and will not be responsible for reimbursing her contractors, we are finishing the job. They cannot finish without the materials. And everything else are factory issues, which I have consulted with the factory and since *** does not like me and says I lie to her, My company is having the factory deal with her directly on all the other issues.
Finally, I am not holding anyone hostage, never have and never will.
Kidnapping is against the law, and I would have no reason to do that anyway.

MESSAGE FROM BUSINESS:
Amy placed a down payment with my company on July 23rd.
We paid a non-refundable deposit of $67,000 with full disclosure that our project was being undertaken to move my mother to our property so that my family could care for her as she suffers from a rare and rapid form of dementia, so time is of the essence.
We require a 25% deposit to order the home.
If in fact, we promised her 8-10 weeks, which is an approximation, that delivery date would have been mid Oct. The home was going to be delayed, due to supply chain issues at the factory at which time, she was notified of the delay.
I was never notified about any delays. I always had to call and ask after emails went unanswered, and it was long after my July 23 deposit had been paid.
She changed the order many times
THIS WAS A CUSTOM HOUSE FROM THE BEGINNING! Your salesman told me we could remove things to upgrade on our own, including wood flooring, ceramic tile and porcelain bath fixtures, light fixtures, kitchen island and appliances. He also told me the factory would remove a wall to make two bedrooms into one room, and also that we could place doors and windows where we wanted. The Lovejoy website talks a lot about all the options available on their homes. I was never told that this was a problem.
The house was customized per customer request.

The contract says the customer is to provide their own foundation, and I was told by David Fox that the only way to guarantee that I could have my parents moved before Thanksgiving was if I hired my own electrician and plumber. Once I had a price of $15,000 less than your contractor bid I of course asked for details regarding the major discrepancy. A concrete floor for a crawl space turned out to be the main difference, and a feature we did not need! My local contractor would have completed the job by now, but instead I have a styrofoam foundation exterior and no crawl space vents 4 months after the foundation was poured. The Fox Block manufacturer website clearly states that the product not be exposed to UV light more than 3 months.
General guideline by Fox Block and not mandatory. It does not affect the integrity of the crawl space wall.

A house went up for sale across the street from me and because of the continued delays and lack of communication I asked if they could promise delivery in time for me to move my parents by Thanksgiving, which was already a month past the original move in date I had promised them. THE WHOLE REASON WE OPTED TO BUY THIS HOME WAS BECAUSE OF THE QUICK TURN AROUND DUE TO MY MOTHER BEING DIAGNOSED WITH A RAPID FORM OF DEMENTIA.
October 19 was a Friday and I asked for a contract stating the agreed upon delivery date of the home (the first one they sent me said TBD for the delivery date) , which was November 1, before I would pay the additional $213,000 up front. I paid the amount the following Monday once I had the updated contract. I was told the house would go into production and take 1 week as soon as I paid.
The November date was based on the information we were receiving from the Factory.
She still wanted to make changes, as late as October 19th but the factory would not make the changes that late in the process.
This is simply not true. There were some light fixtures that were not placed in the right place that I pointed out. This was not a change but a correction.

Continual lack of communication. The only time I got any information was when I emailed and called multiple times. It was excruciating and infuriating. We paid these people over $300,000 and they were ignoring us and stonewalling.

How did they know where to place the water lines for the washer? This is utter nonsense and was never mentioned to me when we discussed this laundry room.

The pan literally hugs the water heater and will not contain any water if the appliance should fail according to our home inspector.
This is a factory issue and the house was inspected and approved before it left the factory.

I requested a punch list of finishing so that we might understand what we needed to do and was told to mind my own business and that I was not the contractor and that I needed to stay out of everyone’s way. As I mentioned above, I was advised to hire my own plumber and electricians by the Lovejoy Homes salesman.

Lack of communication on Lovejoy’s part is not my fault, and there was other work that was done during that trip. The long drive is not my issue — the company said our address was within their sales area.
This was a courtesy item that we were doing for the factory, and we were prevented from completing the work.

The saleman never told me there was an option to purchase my own furnace and water heater or I would have done that. Now I
have a furnace that does not have ducted returns, which makes no sense since the rest of the furnace is ducted under the crawl space. Because of this there are grates in my walls and decorative door which the salesman told me he would have replaced with a solid door without explaining that these grates were necessary because of the passive return system. I would like to at least place the vent above the door rather than at eye level in the door, the same way the bedrooms are done.
The house was built to code and Lovejoy Home Sales has no control over the building codes.

I have no price list, just a total of $12,480.

Nothing could be futher from the truth. Emails and calls have gone unanswered for days and days, and a home that was to be delivered in october and then November was finally set in December but continued to sit unfinished. Because of my mother’s health I cannot afford to wait for your people to do work other contractors were able to carry out.
I stand my our original statement.

Lance Lovejoy has screamed at me and my sister on the phone on four different occasions for requesting timelines, task outlines and assurances that he would honor his word. For being in business as many years as he brags about you would think he would be able to answer simple questions and project manage.
We had several calls on speaker phone so everyone could be involved, and Lance talks loudly during these calls to ensure everyone can hear him.
I am not and will not be responsible for reimbursing her contractors, we are finishing the job. They cannot finish without the materials. And everything else are factory issues, which I have consulted with the factory and since *** does not like me and says I lie to her, My company is having the factory deal with her directly on all the other issues.
I contacted Lovejoy the day the factory-installed water pipe burst to ask what to do. I have never heard back. The warranty book states that my responsibility as homeowner is to mitigate any damage that might cause further harm, so I hired Service Pro to remove the water from the subfloor, crawl space, sill and removed the wet insulation from under the house. I have still not heard a word back despite the saleman I spoke with saying he would contact me as soon as he heard back from the factory four days ago. I have never been proved with contact information for the factory or told to contact them directly.
This is a factory issue.
Finally, I am not holding anyone hostage, never have and never will.
My family has felt like we have been held hostage these last four months since we paid in full, $285,000 + $40,000 for a foundation and have been left without any communication regarding the delivery and finishing of the home we purchased.
We have provided her information as it became available.
Kidnapping is against the law, and I would have no reason to do that anyway.

There are many things in the home that were not done according to plan or have shoddy workmanship, like recessed lighting that was not in the plan walls that are so crooked that baseboard cannot be installed without repair. Your employee was kind enough to do his best to fix one section of wall for us.
These are factory issues that we helped to resolve on their behalf.
This company has terrible customer service and does not stand by their product. Buyer beware. This has been a nightmare.

We were initially approved for our home 7/2022 And promised delivery the end of September. The home delivered November 1. Which was 2 months later than what we were promised. No one from the company did a walk through or inspection so the trailer set empty for a month with nothing done to it when we took possession on November 29th. 1stt Loan payment due 12/2022. Appliances that were ordered in August were not what was delivered . We did not want a glass top stove we wanted a coil top burner stove and the refrigerator had been dropped and would not even power on. We did not get appliances until January 5th. We still don't have our central air unit none of the outside repairs have been made and the upgraded 3 in. concrete skirting that we paid for is still not installed. Our pipes froze four times before they came out and put a box around the plumbing under the kitchen window I have been asking when I will get my skirting on and this is the response I get from the company Unfortunately, I am working on getting people moved in to their homes so I cannot get skirting done this week. I wish I had a crew that could focus only on skirting but that is not the case. I would not recommend a Lovejoy manufactured or mobile homes to anybody this has been the worst experience that ***** and I have went through regarding home purchaseBusiness response

She states that they were originally approved for financing in July 2022. My company does not do the financing, it is done by a third party, and we only assisted her with the financing. They applied for the loan in July and the loan valuation did not come until September 8th, 2022. The approval is pending until they verify all the information on the application.
We received the closing docs on September the 15th and the customer did not sign the closing papers until September the 19th. We also must wait three days after closing for her rescission rights. We are bound by this by the finance companies.
She states that it was delivered on November 1st, two months late. We would have never promised her any delivery date because we do not order the home until the closing is done and the financing is secure. We could not have ordered the home until after the loan had closed which closed on September 19th.
We explained to her that we had to order the house and it would not be built and shipped until the end of October. We received it on or about the 25th of October, which is quick by industry standards. We already had a production slot reserved and we gave her priority on that position for her to get her home built more quickly. We delivered it on November 1st
She was expecting for whatever reason that she could move into the house as soon as she signed the closing papers. That is not how construction works. It would have been impossible even if we had one in inventory, because we would have had to wait to pour concrete and for the site to be ready. We were able to pour her concrete on September the 30th
We had the delivery and set up completed on November 1st. There was some damage to the siding caused by the transporter from the factory. We told her this would be fixed but we had to order the siding first. Also, the weather would have to be such that we could install. The siding is very, very brittle if it is less than 45 degrees outside.
We did some inside work, but we were still waiting to get power to the house on 11/26. It was then we realized that she had not ordered new service for her house. The customer must order new service. The electric companies will not let us do that for the customer. We explained to her several times to order new service and she never took care of that until we reminded her that it was her responsibility which is why it was not done.
We got the power on 11/29. It was then we did a walkthrough and we discovered that the refrigerator was broken internally. We offered to get her new refrigerator, but she did not want anything that was in stock at **** ***** or *******, so we had to special order her appliance. She stated that she would rather wait and get what she wanted. We had to get the approval from the factory to replace the refrigerator which we did the same day. The original delivery date was Dec 14th, but **** ***** changed to Dec 15th without any notification to the customer or Lovejoy. **** ***** is supposed to call the day before delivery and give the customer a 4-hour window for the following day. Instead, they called when they arrived at the home to let us know that no on was at home to accept the delivery. No one was at home when they arrived because they did not give adequate notice. **** ***** then rescheduled for the next available date of Dec 22nd. One Dec 22nd there was inclement weather, and all deliveries were cancelled. **** ***** would not let us pick it up at the warehouse. The only option was it to be rescheduled for the next available date of 1/5/23. We were on the phone for hours trying to get a better date but was unsuccessful. We offered to get them a mini frig/freezer combo to use but they said they already had one.
The concrete skirting is not an insulator it is a cosmetic item. When the pipes froze and our staff went out to the home we discovered the heat tape was defective which caused the pipes to freeze. Then the pipes froze again during sub zero temperatures of minus 35 below. We then went back and put wind block around the kitchen pipes to help during this abnormally cold weather. We will install the concrete skirting when the weather permits. It cannot be installed during cold weather. The air conditioner will also be installed when the weather permits.Business response
