      I had cosmetic surgery on Oct 2023 for several procedures. I have a complaint for the lipo thighs and the bodytite thighs. I visit Dr ********** for 6 months because the swelling in my thighs never went down. I was hospitalized a week after surgery because my thighs, legs and feet were swollen . I was admitted because I needed 5 units of blood which I lost during his recovery process. (30K) For recovery he has you to go to a hotel for recovery and he came to visit me 1 time. The sheets were covered with blood. The next day after surgery I had an appointment to see. He said every looked ok but as time went on I visit him again that same week because of the swelling in my thighs, legs and feet. I was giving a water pill and it didn't work and that is when I went to the *** I was there for 3 days because I had to have a blood transfusion and to also make sure I didn't have any blood clogs. From Oct 23 to May **************************************************************************************************************************************************** for the thigh part of the surgery. June visit came and he agreed to refund me all of my money for the lipo thighs (1800)and the tighten (1000.). I waited 30 days then call to inquire about the refund. He only sent me $1000.00 and the total for the lipo and tighten was *******. I have tried to call him and he will not return my calls. I made an appointment to see him and when I arrived they inform me that he was in surgery and he will call me and that was August 30th. I am an Army Disabled Vet and the VA is trying to figure out what went wrong. The day of surgery with Dr ********** right before surgery he said now what am I doing again, that should have been my clue to cancel and I honestly think he did something wrong. At my final visit in June he did a before and after and he agreed that there was no difference and he will refund me all my money. Massages should have been 6-10 visits I had to have 18 visits.

      Our goal at Aria Cosmetic Surgery is to provide exceptional cosmetic surgery results at affordable prices.  The patient declined to undergo the optimal procedure for her condition.  For excess skin and subcutaneous tissue of the thighs, a thigh lift procedure was recommended.  The patient declined this because she did not want an unsightly scar.  She opted for liposuction of the thighs and skin tightening of the thighs with the BodyTite radiofrequency device.  The patient was counseled that the two procedures would provide some improvement but the results would not be as good as a thigh lift.  The patient had noticeable improvement but she was still not satisfied.  In the surgery contract, which the patient signed, it states, "You recognize that the practice of medicine and surgery is not an exact science and understand and accept that fees are paid for performance of the service only, and not a guaranteed result.  You acknowledge that although a good outcome is expected, and a reasonable effort has been made to establish realistic expectations, there cannot be any warranty, expressed or implied, as to the results that may be obtained."  If this language was not a regular part of plastic surgery practice, every patient would simply express dissatisfaction with the results of the their procedure and demand a refund as a way to get free surgery.  Despite having no legal, moral, or ethical obligation to provide any refund, I did send the patient a partial refund of $1,000.  Given the circumstances of this case, very few if any other plastic surgeon would have given any refund. The potential for postoperative bleeding requiring a transfusion is a well-known potential complication.  This was discussed as part of the informed consent process.

      ok he stated that there was no change with the before and after pictures and that is why he offered me the full refund. I decline the other procedures but that was after my thighs did not go down.  I was not comfortable with him doing any other procedures on me because at this point I did not trust him.  When I went in for the consultation, I explained to him what I wanted, and he told me to get lipo on my thighs and he suggest the thigh tightening to make sure I would get the results I wanted.  I would have never went through with the procedures if he told me it may work and it may not.  Who would agree to go forward with the surgery. He told me one will not work without the other to get the results for me.  That is exactly what I did.  I am not looking for free anything.  I spent $9500.00 if that was the case I would be complaining about all of my procedures.  I am retired military and one thing they instilled in us is honor and integrity.  He agreed to give me back the full refund if the results did not improve by June 2024. I have people that attended my appointments with me and one is a doctor and when he mentioned that its possible, he could have mis diagnosis me or done something wrong, we both look at each other like what did he just say.  If he was not comfortable doing my thighs he should have just stated that and not used me as an experiment.
