      I write to register a complaint regarding a trespass, an unauthorized taking and irreparable damage to our family-owned property by ***** ****** and Meyer Tree Service of ***** ******** ******* *** ****** ** *****, with phone number ###-###-####, on July 25 and August 2, 2022. In early April 2023, I received a letter, proposal and invoices from Meyer Tree Service reflecting charges totaling $1505 for cutting down a 100-year-old, 40-foot, blue spruce tree at our property at 3831 South Grand with alleged authorization from a man identified as Mr. ***** ****** who contacted the company via telephone and email. We do not know who this person is, and he is of no relation to our family. Meyer Tree Service listed Mr. ****** as a resident of our property, but no one lives there. **** and ******* ******, my parents, have been the registered and rightful owners of this property for over 40 years. It is currently for sale and thus not an occupied dwelling or their primary home. No one in our family has ever authorized or entered into a contract to arrange the removal of the tree, which was of aesthetic, sentimental and monetary value to us and our property. It provided the only shade available to the front of the home and was valued as the only blue spruce found in the area. The removal and taking of our tree amounts to significant financial losses to the home and its value, which we estimate to exceed $5000. It is difficult to understand how a company’s failure of due diligence and collection of prepayment for alleged contracted work should become the financial burden and loss of innocent property owners such as my parents. How is it that a random and apparently fictitious individual can make a call, order property work to be done without a written contract, remain absent on the days the work is done and have the work completed without any sort of payment? Meyer Tree Service’s poor business practices have resulted in a violation of our family’s property and rights.

      In response to the complaint from ******* ******* for the property at **** ***** *****. I would like to point out that we did not receive notice of this complaint until May 18th by email.  We did not receive anything by mail. We had the authority and a signed contract in which to remove the tree at **** ***** *****.  Throughout the process of this happening, Mr. ***** ****** was in contact with us and even asked where the payment could be sent and was also having a fire pit put in the back of the house.  It was not until the bill was not paid that I reached out and looked further into it and found out that he was not the property owner.  At that time I reached out to the ******'s to see if they knew how I could contact Mr. ******.  When a customer can not meet the estimator on site when bidding a job, then we send the proposal by email, they can sign and send back and then we schedule the work.  Unless it is a substantial amount of money, we normally do not require a down payment or prepayment from the client.  They pay when they receive the invoice.  This is not uncommon for Meyer Tree Service.  To this point, we have received no confirmation that Mr. ****** was, in fact, not authorized to act on behalf of the owners of the property.  By all indications, Mr. ****** did appear to have the authority to act and the owners did clearly get the benefit of our services.
