We hired ***** of Superior Fence LLC on July 3rd, 2023. We signed the contract and paid him half the total down as a deposit, $1719.40 for materials. We should've known he was a red flag, as he requested the check be written to his personal name, not his business name. It is a small job, only 13 posts with standard 6 foot white vinyl privacy fence and a gate. Our estimated start date was the week of August 1st - 5th. ***** never showed up. Initial excuses were: he had no help, no one wants to work, no one wants to work for the amount he's paying, etc. He kept putting us off starting with a couple days, which turned into weeks, and months. We finally decided to fire him and terminate the contract come October 2023. We gave him one last shot and he finally showed up in the beginning of November (after weeks of constantly texting and calling him with minimal response) and drilled the holes for the posts. He was at our house for maybe 45 minutes and left without saying a word. That is all the work that was completed. The entire month of November 2023 was a back and forth text conversation of him lying to us saying "I will finish this week" or "I will finish tomorrow or be there tomorrow". He eventually told me all this was a lie and he actually took almost the entire month of November off due to his "mental health" due to ongoing family/marital problems. We had the same luck with him in December, giving us the same responses and never showing up to finish the work. Eventually we had enough and gave him a hard date of January 1st, **** to finish the fence or he was fired. Again, we had no response from him. He eventually texted back saying he would finish the fence the last week of December and that is the last time we have been in contact with him. His website no longer exists and he is no longer licensed/registered with the state associations. I have tried calling him and does not answer and his phone no longer has a voicemail. All we want is our deposit money back.

On March 30, 2023, I accepted and agreed to a contract for a cedar backyard fence with Superior Fence LLC in ********, **. I negotiated with the owner, *************************, and sent him a check for 1/2 the total amount, $5245, as requested (for materials). He has since cashed the check. Aside from the initial evaluation and estimate, ****** has done no work on site. No post holes, nothing. He had indicated to start the project in spring 2023 but this never happened. His communication has been extremely poor, with several promises to start which never materialized. In almost every interaction I have had to lead out. After many failed attempts at communication and no progress on the project, I texted ***** that wed rather cancel the project and have our money returned. He agreed. This occurred on 8/23/23, five months after we paid him with no work at all accomplished. Despite ongoing attempts to communicate (on my part), we still have not had our money returned. It has been about 2 1/2 months. At this point I am just requesting help to have our money returned. I can verify all of the above with a copy of our text exchanges. Thank you.
