Paid $32,257.65 on a job that was $38037.65 in total. The contractor went past end date, has not provided contrat, material list and receipts, drawings and has not completed the job. *** exceeded many times he said he would be done. He changed materials from contract on more than agreed. So much more I have prepared for court. Statements, agreements by messaging. Videos. He lied the whole process.Business response

Contract expiry: Oct 23. Finish date: Nov 4. 11
days past contract expiration. There were 7 days delay due to garbage company and electrician sub-contractor. There were another 5 days delay for severe weather. There were also several considerable change-orders initiated by the homeowner. Mainly, adding 11 feet of roof to a portico. Changing it from a small door covering to a 3 column covered porch. The roof added at least 3-4 days. All of the delays were discussed with the homeowner and she was receptive. Despite 17 days in reasonable delays, I would have finished only 11 days after original expiry. I made every effort to finish this job, per the attached contract.wThew problem was initiated when the homeowner yelled at me to "fix the mother {****** gap" between the wall and the parallel deck board. A simple ****** search will tell you, in order to avoid rot you must have a gap up to 3/4". Their home already had rot and mold on the rim joist, siding and sheathing. It's called a "connection gap." Filling that gap would've put their house in imminent danger. I made the client aware of this and finally had to outright say that I won't do it. It would be a massive liability.
As to the deliverv of receipts and a contract:
- invoices serve as a client's receipt in this case. the homeowner has 2 paid invoices and one outstanding invoice. contractors, as a rule, do not provide itemized receipts.
- the client has had a copy of the attached contract from the first day. she has never not had a copy of the contract. Nonetheless, I sent a scan of my signed copy at the end of the job, per client's request. also attached.I currently hold a mechanic's lien on thehomeowner's property for $6,404.00 and am in the process of filing a lien forecl
Ultimately, They threw me off their property 2 hours before I finished a 423 hour iob. Now they're refusing to pay. She told me that if I wasn't done by noon on Nov 4, our contract was void and they didn't have to pay the final invoice. She told me this at 9:30am on Nov 4. Contract expiry plus 16 agreed upon delay days: Nov 8.
Again, I made every attempt to finish this job, per the contract and to the homeowner's specifications. The homeowner deliberately made that impossible.
