In October 2022, I hired this business for two jobs that were not completed yet this business is demanding full payment on Job 1 and extra payment on Job 2. Job 1 is repairing wood flooring and Job 2 is fence staining. The work started 18Oct22 and finished 03Nov22. The dispute is on amount of scope completed, the quality of work, can these two jobs be combined, and the amount owed. Job 1: Restore the floor was agreed as $8200 with $2500 down and then final payment of $5700 upon 100% quality satisfaction guarantee. This guarantee was both stated verbally and is also written on the business’ website. Scope not completed with quality: A. Molding was not removed, replaced, and painted B. Sanding was performed but not with quality. Three professional flooring company opinions, including one with the National Wood Flooring Association, all say these defects were due to using a smaller machine in a way that caused chatter marks and it was highly unlikely that these marks were there before starting the job, which is what owner has repeatedly said. C. Top coat was partially completed – all agree. D. Cleaning was not completed – all agree E. Damaged the household vacuum – all agree. Job 2: Stain the fence: Fence was to be stained for $2750 total during the time that the homeowners were in temporary housing taking an estimate 2 days from start to finish. 18% of the fence was completed at the time the quality and completeness disagreement of Job 1 came into question, so the owner chose to stop work on the fence. I agreed with his decision to stop and resolve the issues. $500 was paid up front for material costs and 18% of $2750 = $495. Also, without any provocation or substantiation, the owner has harassed me for days in >70 texts and 25 email accusing me of potential fraud, larceny, felony, court, lawsuits, and judges - all while bargaining for payment and/or to allow him back on the property to work.

Mr ******* has done things in a very dishonest way and I will be taking him to court so it doesn't surprise me with this. I completed his floor job.  He showed some things he wasn't happy with.  Like discoloration in stain, which myself and 3rd party told him was normal that I did apply my stain right. Second was these dips in the floor that came over time and with the water damage. Maybe was even done during first install but I sanded the out as much as possible. You can only sand so far on the wood before you start messing it up. So these issues he didn't like he was even told that it wasn't from anything I did wrong.  They tried to say home depot rented me the wrong machine and that's not true.  Mr ******* wouldn't allow me to attend the 3rd part discussion and I have not been given the opportunity to go over with a rep of my own and get my own professional opinion. He still hasn't submitted me the other opinion. He's not tried to work things between us.  I had 3 contracts with him. The dining room is complete and no complaints about it but I haven't been given my 1,000$ for. The fence was a separate contract in which I have 1,040$ of my own money involved into and no complaints with that work either but won't allow me to finish and receive payment or at least give back what I have involved in it. I will be taking Mr ******* to court for this situation. I have all my documents from the first time we spoke until now
