      Firstpoint collection resources has placed this account on my credit and they are not the original owner of this account and could not provide documentation that they are the owners which is violation of 15 USC 1681 and a violation of 15 USC 1692. It is the purpose of this subchapter to require that consumer reporting agencies adopt reasonable procedures for meeting the needs of commerce for consumer credit, personnel, insurance, and other information in a manner which is fair and equitable to the consumer, with regard to the confidentiality, accuracy, relevancy, and proper utilization of such information in accordance with the requirements of this subchapter. There is abundant evidence of the use of abusive, deceptive, and unfair debt collection practices by many debt collectors. Abusive debt collection practices contribute to the number of personal bankruptcies, to marital instability, to the loss of jobs, and to invasions of individual privacy.

The account was referred to our office for collection due to the fact it was past due with our client. An initial validation notice was mailed to the consumer from our office on 10/04/23.

       I am rejecting this response because:

      Whoever knowingly participates in any way, or conspires to do so, in the use of any extortionate means
      (1)
      to collect or attempt to collect any extension of credit, or
      (2)
      to punish any person for the nonrepayment thereof,
      shall be fined under this title or imprisoned not more than 20 years, or both.
      (b)
      In any prosecution under this section, for the purpose of showing an implicit threat as a means of collection, evidence may be introduced tending to show that one or more extensions of credit by the creditor were, to the knowledge of the person against whom the implicit threat was alleged to have been made, collected or attempted to be collected by extortionate means or that the nonrepayment thereof was punished by extortionate means.
      (c)
      In any prosecution under this section, if evidence has been introduced tending to show the existence, at the time the extension of credit in question was made, of the circumstances described in section 892(b)(1) or the circumstances described in section 892(b)(2), and direct evidence of the actual belief of the debtor as to the creditor’s collection practices is not available, then for the purpose of showing that words or other means of communication, shown to have been employed as a means of collection, in fact carried an express or implicit threat, the court may in its discretion allow evidence to be introduced tending to show the reputation of the defendant in any community of which the person against whom the alleged threat was made was a member at the time of the collection or attempt at collection.

      Put a collection on my credit report. Cannot validate the debt due to I don’t have a contract with them. The company they claim the debt is for is closed and out of business. This collection agency promised to remove off my report, lied and never did. The consumer had internet service through ***** ***** and was charged for equipment which was not returned and monthly service. ***** ***** is not out of business and still provides services to customers.

       I am rejecting this response because:

      I do not have a contract with you. As you stated that contract is with ***** ***** not you. ***** ***** is not in business. ***** ***** was bought out by Lumos. I do not have a contract with Lumos either. Do the ethical thing and delete this off of my credit score immediately due to this is defamation and breaking my legal rights.

      This collection is reported to only one bureau, I don’t have a contract with FIRSTPOINT COLL RESO, nor did I receive an original copy of a contract signed saying I agree to pay FIRSTPOINT COLL RESO.

      In response to the consumer's complaint, we have 3 balances that were referred to our agency for collection. I have attached the itemized bill and declaration page for each. We are unable to provide a signature due to the fact the documents were voice signed. Each declaration page shows the agency that wrote the policy and the consumer can reach out to them for signature information. Please contact our office if further information is needed.

      Under the FCRA, unverified accounts must be removed and if you are unable to provide me a copy of verifiable proof, you must remove the accounts listed below. The law is very clear as to the Civil liability and the remedy available to me (Section 616 & 617) if you fail to comply with Federal Law. I am a litigious consumer and fully intend on pursuing litigation in this matter to enforce my rights under the FCRA. This company has reported incorrect information and damaged my financial health with an account that they do not own nor do I that is reporting on my credit report.
