I have no knowledge of this company or alleged debt. I have disputed this debt with the credit bureaus and it came back verified i have since then contacted the company and haven't received a response. Furthermore, I am allowed under the HIPAA law (Health Insurance Portability and Accountability Act of 1996) to protect my privacy and medical records from third parties. I do not recall giving permission to ********** ENT CENTER PC for them to release my medical information to a third party. I understand that the HIPAA does allow for limited information about me but any details may only be revealed with the patients authorization, therefore my request is twofold and as follows: Validation of Debt and HIPAA authorization - Please provide a breakdown of fees including any and all collection costs and medical charges - Please provide a copy of my signature with the provider of service to release my medical information to you - Immediately cease any credit bureau reporting until debt has been validated by me Please send this information to my address listed above and accept this letter, sent certified mail, as my formal debt validation request, of which I am allowed under the FDCPA. Please note that withholding the information you received from any medical provider in an attempt to be HIPAA compliant will be a violation of the FDCPA because you will be deceiving me after my written request. I am requesting full documentation of what you received from the provider of service in connection with this alleged debt. Furthermore, any reporting of this debt to the credit bureaus prior to allowing me to validate it may be a violation of the Fair Credit Reporting Act, which can allow me to seek damages from a collection agent.

I have two collection accounts on my credit report that I am not liable for and have disputed multiple times for ******** ******** ********** ******; accounts; ######**, ($456) & ######**, ($481). The date these accounts were "assigned" to FirstPoint are as follows: ######**, January 16, 2019 & ######**, November 20, 2019. Both of these have been on my Equifax Credit Report for years and I am attaching evidence to this complaint. Fast forward to this month's Equifax Credit Report dated April 22, 2022, and this company has changed both of the "date assigned" dates on these two accounts to April 1, 2022, and consequently has made my credit score plummet as now Equifax has recognized them as new collections when in reality they are both from 2019! This has and will negatively affect my ability to obtain a mortgage. The "DATE ASSIGNED" is the date the collection was assigned to the collection agency and these are duplicate accounts that have had date assigned dates of January 16, 2019, and November 20, 2019. They have the same exact account numbers and amount owed. Everything is identical, just the date assigned dates on both accounts changed to April 1, 2022. This is both unethical and fraudulent and I demand that these two accounts be removed from my credit report immediately. This is unfair and now lenders see me as risky with these NEW collections on my report when in fact they are duplicates with the date assigned dates changed by this company. I have attached my March 22, 2022, Equifax credit report as well as my April 22, 2022 credit report as evidence. Again, please remove these fraudulent accounts from my credit report. This company is unethical and has caused me much distress and this is a clear violation of the Fair Credit Reporting Act. If these fraudulent "NEW" accounts are not removed from my credit report immediately, I will exhaust all options, including contacting the NC Attorney General and as well as a consumer law attorney. Thank you.

This in response to Ms. ****** complaint concerning credit reporting dates. I have attached the copy of responses we sent to the credit reporting agency when they ask for verification. We looked at the Metro reporting and saw nothing to indicate a change of assignment dates. I looked in the system that we update credit reporting disputes for both accounts and have attached them. I see where the first dispute was received on 4/1 but I see nothing on the ACDV that changes the dates. There was a letter attached to the 4/18 dispute and it mentions nothing about the debts being on the files two times.  I don’t see anything that we did wrong.

***** ***** Collection Resources is intentionally trying to damage my credit to keep my mortgage application from going though. They are reporting 2 accounts on my Equifax credit report. They waited until I applied for a mortgage to report their collection. The loan was pre-approved, but my home is now under construction. The mentioned accounts are PAID IN FULL, via ****** ****** (original creditor) who when they took my payment recalled the debt from ***** ***** (I have this on a recorded call and willing to provide). The debts in question should not even be reporting! ***** ***** also violated the FDCPA on 2 occasions by contacting me after receiving my certified mail letter telling them not to. (See attached Letter, signature receipt, and screenshots of calls) I have legal council that will be filing lawsuit on those violaitons, however if this credit reporting issue causes me to not qualify for the mortgage, I will also seek damages up to $250,000 for their intentional acts. To further confirm my belief that ***** ***** is intentionally trying to damage my credit, I know the credit bureaus have announced they will no longer be reporting medical collections under $500 and deleting all paid collections. Knowing this fact they were trying to do damage while they could.

In response to Mr. ****'s complaint, FirstPoint had no knowledge that Mr. **** had applied for a mortgage and did not place accounts on his credit for this reason. ****** ******* ****** has reported that both accounts have been paid in full and they will be removed from the credit file on our May reporting.

I am rejecting this response because:

I have an outstanding medical bill payment from ****** hospital in North Carolina, that was due to an injury that occurred while employed at *********** ** ****. We were just recently granted worker's compensation, and was accepted, so that now legally per NC statutes 97-185 and 97-21, this bill is exempt from creditors. Taylor and Tina both advised that since this was an outstanding, high summed bill, they simply could could not remove this from my credit. I was even yelled at and hung up on from Taylor more than once. Since I understand they do not understand NC Statutes (which, they should), I was kind enough to ask to speak to a supervisor. I was then angrily told the Supervisor was not available and that they would only inform me of the same information they did. With this incident, I also submitted the same Workers compensation acceptance letter to other credit bureaus, who without incidence, followed NC Statute and removed this from my credit report. I now have to have a legal team, whom I spoke with today, file complaints and are contacting Corporate so that hopefully they can be reminded of those statutes, and they need to not only get nicer staff who don't hang up on people trying to resolve a debt, but also follow the law.
