April 2021 contracted with SF Ballou for an inground pool, gave company $20,000 as deposit. On 4/18/2021 we passed permit inspection. On 4/13/2021 we passed bonding inspection. On 4/16/2021 we passed set back inspection. On 4/17/2021 we passed zoning inspection. SF Ballou anticipated delivery Sept. 1, 2021 per email of 5/4/2021. SF Ballou changed delivery date by email on 6/7/2021 to Oct. 1, 2021. SF Ballou changed delivery date by email on Oct. 13,2021 to Dec. 1,2021. On Nov. 16, 2021 I cancelled contract with SF Ballou due to death of my spouse and deteriorating mental health of my mother. On Nov. 17, 2021 *** ***** of SF Ballou emailed that they would see what cost the company had incurred and would send a check in the next few weeks. At this point the only cost to company was the pool shell. Jan.11,2022 emailed company and asked for an invoice for company cost. After numerous request for invoices, *** ***** stated via email on May 19,2022 that a check would be mailed to me for $18,600. June 9, no check had arrived so emailed *** ***** as to when check would arrive. She stated in email, would be sending the following week. TO THIS DATE HAVE STILL NOT RECEIVED CHECK.
