Back on July 10 2019, a driver who was insured by Progressive rear ended my 2019 Acura ILX in ****** Township, **. I worked with Progressive to get my car repaired by Exclusive Auto Collision Center in ******, **, as Progressive paid for the repair in its entirety since your driver was at fault, and I ultimately picked up my repaired car on/around 8/27/2019.Up until last Thursday March 23rd I had not thought about this accident, until someone rudely and loudly banged on my front door and dropped off a stack of papers that said the body shop who repaired my car is suing me, Progressive, and 168 other parties for *underpayment of services*. Im not sure how or why Im being sued, since all the paperwork that I have from this accident indicates that the estimated amount was agreed to by all parties and then paid by Progressive. Because according to the paperwork I received, this lawyer is seeking I pay an additional $1131.57 which ironically is almost the same amount as my initial repair estimate $1128.44 that was increased by Progressive to $1358.85 after personally reviewing the damage at the body shop.

the repairs were done to the vehicle and a contract was signed by the customer *********************** , in our repair contract it states if we do not collect the monies owed from the insurance company any remaining balance is the sole responsibility of the vehicle owner. Progressive did not pay the entire invoice and the remaining balance is owed as per our contract. We have been attempting to collect from the insurance company and have asperated all avenues to no avail. *********************** can attempt to collect from the people who hit his car for any monies that there insurance company did not cover

I am rejecting this response because:

Aside from the fact this issue occurred back in 2019 - almost 4 years ago - at no time in the interactions before I brought my car in for repair, during the week+ my car was in the shop for repairs, or on the day when my car was ultimately released to me by the business was I ever told or provided documentation about the cost of the repair exceeding the cost I understood the repair to be.

Had I been told that or been given documentation about this difference in cost, I would have (at best) referred this issue to Progressive to resolve since they committed to me to pay the entire amount to repair my vehicle to its pre-accident state and they also approved this business to do the repairs or I would have (at worst) refused to pay the extra amount and then the business could have either not released my repaired vehicle to me or returned me my vehicle in an incomplete state.

Further, I was not provided a copy of this supposed form that I allegedly signed and agreed to pay any additional costs beyond what Progressive paid. And if it was in fact presented to me for signature, it was presented to me under false pretenses by the business and not made clear that I would be held liable for the extra costs at all, more or less almost 4 years after the fact.
