    I must remark that Thomas *** Fishers failure to respond to our request for service is rather disappointing but not unexpected. Considering the difficulties this firm had with permits, knowledge of the local codes and a cut electrical line (that still isn't repaired) I ignored what I consider unprofessional conduct. Moreover, the company's tendency to shift blame for the problems they encountered on the job caused me to consider terminating the contract.TLF was paid in a timely manner and everything they requested of me was provided including a survey of the property.Now I am working on correcting the apparent absence of a pop-up drain that is causing the sump pump to move water out of the sump box which your company is ignoring. I will see if I can fix this problem myself but if not, I will hire someone who can correct this defect and then *** TLF for the costs.

    To Whom It May Concern,Thomas *** Fisher **** was more than willing to address the problems as asserted by the customer, unfortunately, being a small company we were not able to send a crew the day the customer called, and he was unwilling to have us deal with the problem in a reasonable time frame.In reference to the complaint concerning the permit situation, our contract explicitly states that it is the customers responsibility to obtain all zoning, historic preservation and other permits, necessary to complete the job. Also the customer is to provide a survey, which was eventually needed during the job. It should be noted that when permitting issues were raised, Thomas *** Fisher **** provided the resources necessary to obtain the permits, and applied for the permits, all of which took several hours of labor, for which the customer was not billed out of courtesy.In reference to the damaged electrical line, Thomas *** Fisher **** called the **************************** to obtain **** outs. The lines in question were not marked. We cannot assume responsibility for unmarked utility lines or underground obstructions. The local utility company was informed of the damage, came to the site, did whatever they deemed necessary and afterwards told us to fill the area in. If the lights are still not functioning this is a problem for the utility company, not us.With regard to the sump pump, we did not install the pump, so testing of the pump was not our responsibility. We were contracted to install piping, a clean-out, a pop up, infiltration drainage, housing for the pump with passive drainage for any excess water and grading as specified in the Township permit. This work was done in accordance with the plan and was inspected by ************* for the township. Whoever installed the sump pump should have been responsible for final testing and informed us of any issues which we would have been happy to address.We are a responsible company who has been in business for 45 years, and as such we are dedicated to customer satisfaction. This has been an unfortunate situation, and we are still willing to correct any difficulties if the customer is willing to work with us.

    As a customer I couldn't possibly know the permit requirements that TLF asserts was my responsibility. So regardless of what the fine print reads combined with the fact TLF initially asserted that permits weren't required is what I relied on. Had permits been obtained they would have been required to place the outlet a sufficient distance from the underground power a sufficient distance from the underground power (which still hasn't been repaired) that would have made this discussion moot. As they remarked they have been in business for 45 years and accordingly should have known (or verified) that this township required permits and should have told me (if it really was incumbent upon me to get permits). This isn't their first rodeo but maybe 45 years of experience translates to one year forty-five times. Instead, they just went to work and when the damage to the power line occurred they, like an amateur shifted blame. Regarding the pump. TLF should have tested the system to see if it was working. If there was a problem with the pump (I checked it and there isn't one) or the line which may have a restriction in it, wasn't determined until a rainstorm revealed it. Now they want me to pay for correcting a problem. I looked for the pop-up valve but everything is covered with a straw mat so if it's there it isn't visible which may explain the restriction.
