My right to secure a rental property was violated by JMS Properties when I applied for a house in *********. The property owner hired JMS to find its tenants. After a discussion with my realtor, he told me the requirements to apply & seek an approval to rent. I acknowledged that I met the requirements and submitted an application with a $65 money order. My credit score is higher than the minimum score JMS required to apply, and I have no criminal record. JMS knowingly hired an outside company to run a background check on me, but the record came back with a disclaimer from ********** stating that "the report does not guarantee the accuracy or truthfulness of the information as to the subject of the investigation and was copied from the public record." After waiting several days for a response to my application, I did not hear back from the Agent *********************** so, I reached out to my realtor for a response. I was told that my app was denied due to my credit. After reviewing my credit score again, I challenged this answer because I exceeded the base credit score JMS required. Later *** responded to my email and said I was denied due to a criminal issue that came back during the background check. I denied having a criminal issue and demanded a copy of the report. I noticed the ********** warning & Infraction which was a civil citation for a moving violation for driving with a cell phone! I immediately informed JMS property management that I wanted a refund of my $65 an apology because their hired company who did a background check did not investigate the civil infraction code, nor did JMS properties verify the infraction was civil not criminal. JMS wrongly assumed the violation was criminal in nature and denied my application, but it was not! Therefore I was not allowed to rent the house I applied for. ******************* refused to offer me an apology & return my $65 application fee as compensation for JMS ************************ to investigate California Civil Codes.Business response

****************** emailed and asked if we had any applications. She could not find our office. I replied back and told her none but are expecting one. She proceeded to drop off her application the next day and at that time we had the one plus 2 others. It does state in the *** that we will run multiple applications. Her credit report, which is ran by Experian, came back with unacceptable findings to us based on the criminal issue as well as credit limits higher than we would like to see. We determine things as a whole and not just the score itself. We do not see or look further into this. It is not our job to investigate what is on a credit report nor would we have access to something like that. We especially did not need to ask her anything further when the other applications were much higher score wise and NO further issues. She is asking for a refund on the app fee but it clearly states on our application it is a "NON-REFUNDABLE APPLICATION FEE." She signed and initialed this page. I am rejecting this response because: ******************* and all those involved in accepting the report of their untrustworthy background check company is completely flawed. ****** realtors have a practice of accepting multiple application fees to line their pockets and treating people like a number. I have no criminal issue which is the point but JMS Properties should have took it in good faith to offer me an apology or offer to apply my application and fee towards another unit. However he simply moved on as if I would take this lying down. Nonetheless, the application he claimed he was waiting for could have been mine. My realtor told him I was coming by. He offered no solution to their flawed process but took my money instead. People with excellent credit history should never be reduced to a simple credit score because these scores change monthly but does not necessarily mean the applicant has bad credit or going to be a risk factor. JMS Property managers are not lenders and have embarrassed themselves. Integrity matters here and my background report also reflected excellent payment history however JMS properties acted like I was at risk, told me I had a criminal issue which is not based in any fact and I vehemently deny. Qualifications to purchase houses are more welcoming but these greedy Realtors only concern is making money. In good ****** He should have refunded my money since he ignored the ********** Disclaimer advising that the report was not solid. Moreover, only a fool would classify a ticket as a criminal offense without research. The words criminal are not even on the report. JMS Management acted reckless and irresponsible and must be held accountable- period. I will be taking my complaint to the ************************** and HUD and other agencies to put a stop to these practices!
