      July 12. 2024 **** Young and Son Asphalt paved a portion of our driveway without the permission of us 5 home owners. They solicited our 72 yr old mother who has the onset of dementia and alzhemer to do the work and charged her $9500.00. When they were informed that she had no right to authorize the work they proceeded to call her and discuss the issue with her instead of dealing with us home owners. We asked for a detailed receipt of all work done including but not limited to cost of man power, time it took to complete job, cost and list of materials used. We have not received this receipt. We scheduled to meet with the owner of the company on either July 25th or 26th after 430, at a time all 5 home owners would be in ** at the residence. On Thursday July 25th I contacted the company to confirm the meeting and was informed that due to rain they were behind schedule and would need to meet on Friday. On Friday July 26th upon arrival of all home owners by 430pm we were informed the owner came that day in the morning and AGAIN spoke with our Mother whom he was formally made aware had no authority. An email was sent with regards to his failure to hold the meeting as agreed and again a request has been made for a detailed receipt. The owner/company has ignored the email and obviously refuses to provided us home owners with requested information. Was advised this company tried soliciting other family members to do same thing. Found out they were previously paid for materials from another job and charged our mother again for these materials to receive double payment. All can be confirmed with emails between myself and company.

      To whom it may concern, I have been doing residential and commercial paving work in the never sink area for a couple months
      While I have been paving a commercial general store, I have had numerous people stop into me asking me to do work for them at various locations 
      Some people give me their address. Some people give me their phone number. Some people even say some things like five houses up on the left or three doors down on the right or something like that. Come stop to me. Ill be around. Were interested in having work done. 
      So I stopped to the residence because I thought I was told that someone was interested in doing work there because of water issues from the street 
      I asked if the person was the homeowner and she told me that she was and then she told me she would like to pave the front section of her driveway because it would clean things things up in the front of the house not bringing so much dirt in 
      It was July 12 around 8 AM 
      I told her that the work would include excavation compacting, fine grading compacting and installing ************** approve hot asphalt and compacting that as well she said lets start down here and go as far as you can with one load of material and I told her every thousand square feet would be 5000 
      She said that is fine. Do you know exactly how much you can do 
      I said I dont know exact amount but I know I can do a good size portion maybe around a couple
      Thousand square feet 
      every thousand square feet would be 5000 
      I told her I would lay 1000 ft. and see how she liked it and if she wanted me to keep going, I would do so 
      keep in mind this is at 8 AM in the morning and blacktop is time sensitive material so if I had blacktop from another job, how would it be able to stay hot overnight as they are saying I had blacktop from another job site? 
      The blacktop plant opens up at 7 AM and it is an hour ride from *********** to never sink
      So Im not really sure what they are trying to accuse me of by double payment or whatever slander they are saying 
      I have sent numerous emails to ***** back-and-forth explaining how it is difficult for an owner operator to make it exact times during the week as sometimes I work far away and if I am stuck on a job site, I cant just pack up and leave the job half done however I explained to her that Saturdays and Sundays are a lot more easier for me to meet people when they have a certain time set aside 
      She said about meeting me on a Thursday or Friday and I tried to make it that Thursday however I was stuck on a job site and the next Friday I was paving in an area with not 1 ounce of cell phone service so I figured instead of missing another appointment to look like I was avoiding her I would stop in with hopes of Being able to talk with at least one of the other homeowners that she said on the property
      It was unknowing to me that nobody would be there aside from her son and her mother 
      However, previously stated in emails to ***** when I was paving her mothers driveway her mother sister was there half the time and I would think that if her sister had dementia or Alzheimers or any kind of neurological issues that would permit her from having things done, she wouldve said that I am dealing with a sick person, and if that was the case at that point, I wouldve never proceeded with any work 
      I have a mother and a grandmother and would not take advantage of them 
      Also, when the job was just about completed, brother stopped to the job site and I went over the job with him for about 20 minutes and the only issue he had was that he wouldve liked to have done the whole driveway instead of a piece 
      And also never at any moment did he say his mother is sick by any means he actually was thinking of having me do work at his house, but he wasnt sure how it would work because he shares a driveway with his neighbor 
      After numerous text back-and-forth, I did explain and break down to ***** in an email. What type of work was done what kind of material was used and things with explanation to the job? 
      However, I did not get into what my labor costs are as per insurance, benefits and retirements and hourly wages. I dont feel are any of her business, but I did tell her that I had people working on the job site that have as little as a year experience and as much as 30 years experience, so we have a wide variety of help , that are very experienced
      The day I stopped back to explain that I could not make the 430 appointment that Friday morning. I also had a funeral to go to that a family member passed away in the state of Delaware. 
      I did speak with her mother again and she did once again confirm to me that she is the owner of the property and has full responsibility to do improvements on the house and that other family members are not sure why ***** is acting the way she was acting
      I am a local business owner and take matters like this very serious so anytime that I have been reached out to. I respond promptly. 
      We are very fortunate to be still in business after Covid and we take on any kind of work that we can get 
      I can provide all the emails that have been sent to me from ***** and I can provide all the emails that I sent to ***** as well 
      As I stated before, I am a small business owner operator and look to make sure all of my customers are happy 
      I cant make it clear enough that at no time any member of the family seemed to display any sign of neurological issues

      In response to complaint #******* which contains inaccuracies. First it is clear the work done on the property was solicited as it was stated he stopped by assuming someone told him this was the house wanting work done due to water issues. At no time did anyone reach out to this company to perform work or request an estimate for work to be done. Second, if he showed up at 8am unknowing of what work needed to be done, how was it to be known the amount of materials needed,what materials needed, amount of labor needed to perform the job?  Why would a contractor, knowing material for the job is time sensitive pick-up materials, drive an hour without a prior agreed upon contract? It is stated that the materials were picked up in ***********. *********** where?  ***********,** is only 24 minutes from *********, not an hour as stated. At no time was there mention of any experience by people performing the work. As a small business owner my prices with clients are fully disclosed at this is only ethical as a business owner.
       At no time is documented anywhere the cost of square footage, nor does my mom remember being given a breakdown of costs per square footage, being offered to have a section done to see if she liked it or not or materials used, neither does the yellow piece of paper left provide any costs of work done or total square footage of work done. As of the date of this response, we still have not received requested information
      My four siblings and I are the homeowners of the property. A copy of the deed from our attorney will be provided if needed. Our mom has living rights at the property.All repairs are discussed with all prior to any work being conducted to ensure all homeowners are in agreement with the work being done and the cost to perform the work.
      With respect to my moms medical condition not being disclosed by my brother or my aunt.This is the first mention of the company even discussing or having communication with my aunt who no communication was done between my aunt and this company. As I have told the company, I am the care giver of my mom. I am the only one who attends doctors appointments, holds meetings of care for my mom, and has access to her records. Neither my brother nor my aunt will disclose my moms condition as they are not fully knowledgeable about it. Nor is it the companys business to know the severity of my moms medical condition. Any person with a loved one diagnosed with these conditions would know and understand the sensitivity of it and for this company to discuss my moms condition with her is appalling to say the least. Upon my arrival home on July 26, 2024, my mom was extremely upset and confused due to the company bringing her condition up when I was not there. To call and speak with her directly after being told by myself and my brother she is not the homeowner is absurd and harassing also. And when speaking with my brother on July 12th he was angry/upset and was questioning **** Young and Son Asphalt why they were taking advantage of older people at which time was it said he had to leave for a funeral but did not disclose where the funeral was.
      At no time was it discussed the difficulty of a time for the company to meet all the homeowners as three of the five were in NY from out of state for a short period of time.You will see in the provided emails the time frames July 25 or July 26 after 430pm as that would be when all homeowners would be available. At no time was discussed or mentioned that any homeowners would be available at another time.As seen in the email it was suggested I call as the company does not always check emails. I called from a recorded line from my job on July 25th in the am to confirm meeting time. Was told that due to rain could not meet on that day but Friday would be better.  AT NO TIME WAS IT SAID HE COULD NOT COME AT THE AGREED TIME OF 430pm, or he had a funeral out of state. The ONLY mention of funeral was on July 12th to my brother during their discussion when I brother first informed this company our mother was not the homeowner. If he mentioned he could only come on Sundays he would have been advised due to my job, Sundays are not good, and the other homeowners were leaving ***
      With respect to mention of slander. I have had another local family from ********* come to our home after hearing of the company who did work on our driveway and tell us this same company did come to their residence on ***************, ********* and they had just finished a job and had left over materials and would pave their driveway if they wanted. As a small business owner myself, slander is not something I take lightly
      With respect to comment of "other family members not sure why ***** is acting the way she was. Is a false statement. Four other homeowners/siblings are in agreement with the complaint and are on board with all aspects of filing this complaint and any further actions if needed. This is verifiable with emails and texts.At not time did anyone from this company communicate with my son or Aunt. The work had already been completed when both were present.
