    Government Action: BBB reports on known government actions involving business’ marketplace conduct:
    Attorney General James and State Police Superintendent Corlett Announce Indictment in Million Dollar Contractor Fraud Scheme

    The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government’s allegations, which have not yet been proven.

    October 5, 2020, NEW YORK – New York Attorney General Letitia James and New York State Police Superintendent Keith Corlett today announced the arrest and arraignment of Robert Decker, a/k/a Bob Dale, 66; Scott Driscoll, 44; and Robert Langlais, 67, for their roles in a large-scale contractor fraud scheme perpetrated against dozens of unsuspecting homeowners and businesses across upstate New York. The 17-count indictment was unsealed in Albany County Court today before the Honorable William A. Carter.

    According to statements by the OAG and documents filed in court, between at least May 2018 and October 2019, Decker and Driscoll operated SJR Enterprises, LLC (SJR) as a home improvement contracting company. The indictment lays out how the two defendants fraudulently obtained hundreds of thousands of dollars from dozens of upstate homeowners for home improvement work they never performed or failed to properly perform, as well as nearly $100,000 in fraudulent loans and materials never paid for as promised. The matter is pending.     Pattern of Complaint

    On July 2, 16, 31 and August 6, 2019, BBB attempted to contact SJR Contracting regarding a high volume and a pattern of serious complaints. During the past 36 months, BBB received complaints regarding payments for work not performed or incomplete. The business failed to respond to seven complaints through BBB's complaint process. Complaints state the company collected deposits for work ranging from $6,250 to $89,000, with an average of $33,902.

    BBB notified SJR Contracting of these complaints and asked them for cooperation to eliminate the pattern. We asked for a written response outlining the steps it would take to avoid similar complaints in the future. 

    BBB also requested additional information, including: Federal Employer Identification number (EIN), the names and full contact information of the company's principal officers and management, copies of contracts, including if work is done by subcontractors and if customers are notified, the physical address of its principal office, copies of required competency and/or tradesman's licensing, and a completed BBB Standard Business Questionnaire.

    To date (August 6, 2019), the company responded that we need to reach out to an attorney handling this matter. We have not heard from SJR Contracting or an attorney.

    BBB is also unable to verify any contractor's or tradesman's licenses required for services such as stairlift installation. BBB urges consumers to use caution based on complaint activity and lack of responsiveness.
