      On July 29,2021, Joseph Mastroianni, owner of Mastroianni Engineering, entered into contract with me to provide engineering services in creating an access drive to my property at *** ******** ***** ******* *** ***** The services Mr. Mastroianni was to provide included detailed drawings, including two dimensional renderings with such detail as gravel to be used and culvert pipe placement. The work was also to include submitting drawings, plans, and completing the wetlands permitting process with the NYSDEC. Mr. Mastroianni received a $1000 retainer which was to be deducted from the total cash payment for the job. He cashed the $1000 check and never contacted me again. I had been trying in vein to contact him via text, email, U. S. Mail and phone since then with no response. I know he has been screening his voicemail because at times his voicemail is full then other times I have been able to leave voicemail. My phone records back to September of last year verify I have called his cell at (315) 278-0261 at least 20 times, I have also tried contacting his via email at **********************. I drove to his business at P.O. Box 2572, Liverpool, New York 13089.The contract stated we would be billed monthly and be provided updates for services rendered. I relieved him of his contract duties via letter from my attorney and am seeking reimbursement of my $1000. I

      The client wanted something done, and was given a price. It required a surveyor to provide topographic mapping. This transpired in July of last year. With a couple of months the consumer was complaining on why this was not completed. The owner did not receive anything from the surveyor until November of last year. (can prove with email from surveyor) In December the owner suffered a heart attack. The owner is intending to finish the drawing, but a driveway cannot be put in until the weather dries up.

      I tried to attach a copy of the work proposal from Mr. Mastroianni that described the work he was going to perform and was contracted to do. Hopefully you received it. In the proposal he had written detailed tasks that he would perform and stated I would be billed monthly as things progressed. I never received any monthly bills he never contacted me about the work,  and I saw no documents that support any work on my project, and by his own admission he did not perform any of the required documentation for months. No filed permits, project scope, site package plan, drainage and erosion control plan, etc. These were all activities he never initiated to begin the DEC permitting process. After I made numerous phone calls, sent emails and texts, as well as visits to his office (closed and locked doors) he never responded to any of my efforts to contact him and he never performed anything he had agreed to in writing. I continued to ask him for any communication into February of this year but never had any response. I even contacted the DEC regional representative in Syracuse via email, which I have saved as proof, to see if any documentation had been filed for my project, he told me there was none. I certainly do not wish any ill health to Mr. Mastroianni, but, why from July of 2021 until present he has done nothing, not even responded once to my many attempts to contact him. He cashed a $1000 check which was to be deducted from my first invoice which never came. With any effort at all Mr. Mastroianni could have rectified this bad situation, which has gotten both of us to this point. If he was waiting for the survey crew to send him information should he have not tried to contact them or me to see why there was any delay? I did contact them they told me they heard nothing from Mr. Mastroianni.  There has been no engineering work performed for this project and it has cost me cash outlay to the survey team and $1000 to Mr. Mastroianni. I'm no farther along with this project than I was in July of 2021.
