      JW Smith was contracted to perform remedial paving work on a driveway, which involved new pavement cut-in to existing pavement and repair of portions of existing pavement, as well as to seal all pavement upon completion of the paving work. The pavement work commenced on April 15th, 2021 and was completed in one day. Soon after the work was completed, there were problems with the workmanship, and JW Smith did not address these deficiencies. During the Summer of 2021, JW Smith finally agreed to come over "to take care of it" and stalled for over a month. At the agreed upon time, two of the most junior people arrived, without any crew, materials, or equipment, which made it clear that JW Smith had no intention of correcting the improperly installed pavement. As of March 2022, a portion of the newly installed pavement has broken up, exposing holes to the underlying base. We were told by other contractors that the cut-in was laid too thin, and not properly hand raked. One contractor was _surprised_ at the lack of quality for such a basic job, and stated it was a disgrace to the grandfather who established the business. The Agreement from JW Smith states that the work is guaranteed for one (1) year from data of completion. JW Smith has not responded to repeated contact attempts, and based on last year's lack of action, it is clear that JW Smith will not stand behind their work nor correct the ****** pavement. We seek a full refund of $4,500, which was paid by ***** Fargo check #*** on 15Apr2021 as payment in full upon completion of the original work including $3,500 quoted on 17Mar2021 and additional work for which $1,000 extra was paid for a total of $4,500.

      We have responded to the complaint and have them on the schedule for repairs. Our office is seasonal we close Dec 1 so we did not open and never received and complaint until  April when our office open back up. Thanks!

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID# ********, and have determined that my complaint has NOT been resolved because:

      The business, JW Smith Paving, tentatively scheduled repairs on 06May2022. As of 26Apr2022, the repairs have not been completed. This sounds reasonable, but we cannot accept the resolution because so far there is no resolution, only an offer to remedy the issue. When it is repaired satisfactorily, we will be happy to accept the repairs as resolution. Given that we brought issues to their attention last year soon after the original work was completed, and subsequently no remedial action was taken, we remain skeptical until the actual remediation has been completed. We are encouraged that they willingly scheduled a repair visit, and hope that the work is completed satisfactorily and we can move on with other things.

      Please contact us again after 06May2022 to determine if the work has been satisfactorily completed (or when the business responds to BBB saying that they have taken care of the needed work).
