On 9/6/2023 I parked in a parking spot located at *** ********* ******* ********* *** in the parking lot designated for ******* ********** ******, where I had an appointment for a family member. When I returned, approximately one hour later, my car had been towed. There was what appeared to be a partially removed handicap symbol on the pavement, but no posted sign. There are other spots in the lot which HAVE a posted handicap parking sign, and again, there was NO posted handicap sign where I parked. The only sign in the area in which I parked designated the lot for ******* ********** ******* The doctors office apologized and said they don't consider it a handicapped spot, but that I would need to contact Buckingham Properties, which I did immediately. I explained that there was no posted sign, and that the spot in question did not meet ADA requirements for posting of a handicap-accessible parking spot, specifically: "Parking space identification sign with the international symbol of accessibility complying with 703.7.2.1 mounted 60 inches minimum above the ground surface measured to the bottom of the sign." (ADA.gov) When I contacted Buckingham, "Lauren" said she would talk to the "garage" and see what could be done. I was later told that the Property Manager approved the towing and that the tow operator would explain why I was towed. His explanation was "I tow 100 cars from there every week" meaning NO explanation. If Buckingham intends for the spot to be restricted, it is non-compliant and my vehicle should not have been towed. Most importantly, Buckingham Properties parking at this location is against ADA code and should be investigated.Business response

BBB spoke to the business owner and the following was relayed: I have spoken with Ms. ****. After she brought this to my attention, I sent her a check to cover the towing expense for her. I also ordered new signs, I'm not sure where the old ones went but once Ms. **** made me aware that the sign was not there- I ordered a new one and will be installing it as soon as it is delivered. In the meantime, I've also repainted the parking spot with fresh paint. So, with the new sign and the repainted spot we will be fully ADA complainant again. And I reimbursed Ms. **** as well for her troubles. Thank you.
