I would like refunded all my money I paid for insurance an my license given back to me for their failure to send in paperwork that is required by law on their side to send in or else they'll lose their license an or company for insurance from what I was told. Business response

      09/20/2022

This memo is in response to Mr. ***** ******** complaint that an SR22 filing (proof of insurance filed with the state)  was not made, which “caused him to lose his insurance, license and car”.

Below are the facts that are in our records and we will be glad to provide these documents for Mr. ****** if he contacts us.

On 11/1/2021, our agency wrote a policy for Mr. ****** through Progressive.  An SR22 filing was made to the state by Progressive.

The agency does not file the SR22, but when it is requested on the application, it is then filed by the company.  The SR22 filing was listed on his policy and all subsequent endorsements for the entire time the policy was in force.

On 2/3/2022, Mr. ****** called the office to advise that he would not be able to make his payment.  The EFT payment attempt made by Progressive was returned as non-sufficient funds and a pending cancellation notice was issued by Progressive with an effective date of 2/18/2022.

On 2/7/2022, the agency left a voice mail for Mr. ****** advising of the pending cancellation of the policy effective 2/18/22.

On 2/11/2022, the agency sent an email to Mr. ****** once again advising of the pending cancellation effective 2/18/22.

On 2/17/2022, the agency again left a voice mail for Mr. ****** with the amount due to prevent cancellation effective 2/18/22.

On 2/18/2022, the policy was cancelled by Progressive for non-payment of premium.  At that time, since there was an SR 22 filing, and Progressive no longer provided insurance coverage, they notified the state of the policy cancellation.

On 2/22/2022, the agency spoke with Mr. ****** advising the policy had cancelled effective 2/18/22 and providing the amount due that would be required for reinstatement with a signed statement of no loss.  Mr. ****** said he would try to come in to pay later in the week.  He never made payment to reinstate the policy, therefore, the policy remained cancelled with no coverage in force.

An SR22 filing is proof of insurance provided to the state by the insurance company – at the same time, if the policy cancels, the state is also notified when the policy cancels.  Our agency did nothing wrong as all filings were made as requested, but the policy cancelled due to non-payment of premium on the part of Mr. ******.  This non-payment of premium on the part of Mr. ****** resulted in the cancellation of the policy and any subsequent action by the company and state.  There will be no refund of premiums paid to Mr. ****** for the coverage provided during the policy period of 11/1/2021 through 2/18/2022.
