New ATV purchased from this business June 26, 2021 for $7000 cash. This included a winch and a snow plow specific to the model. Owner ***** *******r delivered it. It would not start/stay started. It sputtered and stalled every time I put it in gear. He said it was bad gas/bad spark plug. His mechanic changed those, it ran off/on for awhile while we slowly put on the requisite 50 miles riding on the engine (in order to pull a small bushhog, which we were told would be easy for this ATV to do). It sat for about a month, and then in November 2021, tried starting it and would not even start, just kept draining the battery trying to crank it over.. Took it in for repair at their business in Dec 2021. I have been requesting since June 2021 a swap out with another new unit. They refuse. Wanted to upgrade us to a unit that cost an extra $2500. It stayed in shop, not repaired, until beginning of April 2022. They claimed we or someone else put SUGAR in the gas tank! Repaired tank and other parts. Started and worked for four rides. After 4th ride, turned off and tried restarting an hour later and would not start. I called business again today 4/26/22. Got put on hold indefinitely. Called again and was told by ***** that the mechanic is talking to the owner (*****). Never returned my call, nor responded to text to personal cellphone of *****. They have refused to replace the unit since day one with another new unit. Only made another offer while it was in the shop over the winter to upgrade to another unit that costs $4000 more now!. Would not replace with similar priced unit. They tell us to just sell it ourselves, and cannot do that as it does not run. We have a snow plow that we paid $1300 extra for that is sitting unused. Could not use it over the winter because ATV was in the shop for 4 months. I do not know what to do about this after a year of breakdowns. I would rather just get the $7000 back in cash and return the unit/snowplow and be done with them.Business response

Mr. & Mrs. ****** was in the dealership and purchased a 400cc Atv. Plus a snow plow and winch in June 2021 for an amount of $1,278 and change.. The Bill of Sale is correct. Although, the salesman told Mrs. ******, a 400cc is not a unit to push snow. He suggested a 550cc and her statement was she didn't want to spend that much money. NO clue she was going to attempt to use it for bush-hogging.o That unit is very small and should not be used for plowing snow or bush-hog.
***** ******* did deliver the unit for free and normally we charge $100+ for delivery. The mechanic did go to the ****** house to fix the issue. We normally do not make house calls.
In the colder months a battery tender should always be put on the battery to avoid the battery from not being ran down.
Mrs. ****** brought their unit in for repair in December 2021; the findings were that someone put sugar in her gas tank! Assuming it was one of her employees put the sugar in their gas tank. ALTHOUGH it was not under warranty; out of the goodness of the owner's heart; he paid for the parts out of the company's funds. No other company would have done this! Unfortunately, with covid and the pandemic parts are taking forever to get in. We have waited 9 months for parts for different units. Actually, her parts still are on backorder and still not available to ship. To attempt to keep her and her husband happy; the owner said to take the parts off another unit so we could get it fixed. (see attachment). This is a Manufacturer issue and we are doing the best we can to get the parts. The unit was completed March 26, 2022 but she didn't pick it up until the beginning of April 2022. When she picked it up **** o requested for her to take a ride on it to be sure everything was ok, her comment was I trust you guys; I am sure it is good to go.
We have not refused to switch the unit out; for an upgrade it is $2,500; Mrs. ****** didn't want to pay the difference. The cost of living, freight has more than doubled since last year and the units have went up as well; so, yes it is now a cost of $4000 to upgrade the same unit. We make less then 20% on the units.
She did call into the office; I happen to be the one that answered the phone and transferred her to **** (service);she said, just the one that I need to speak to. He put her on hold to speak to the Manager since the owner was out of town to see what we could do. The Manager said for her to bring the unit in to see what the issue was and we will go from there. ***** was out of town and requested for service department to call Mrs. ****** back. **** said he left her a message and hasn't received a phone call back; obviously because she contacted the BBB.
We are not a retail store; we do not return units. We will look into it and see if we could take it on trade. Although, we purchase units at wholesale prices to sell them at retail. This is why we told Mrs. ****** to sell it herself.
I have attached the repair order; we covered all parts and labor except for an oil change and when we told her $59.95 her comment was are you serious you are going to charge me for an oil change? We did!
This unit is under warranty for one year from purchase date; normally it is 90 day warranty. If she would like we can purchase a 12 extented warranty through ASC for the unit and the owner will pay for this. This is our last offer and will not take any further monies out of the companies pocket for items. We will service the unit for her and will file for warranty claims on the unit but I feel we have went beyond our call of duty.

I am rejecting this response because:
There are so many false statements made by the business that I will address all of them:-"The salesman told Mrs ****** a 400cc is not a unit to push snow". When my wife and I arrived at the business, salesman "*****" greeted us and asked how could he help us. We knew nothing about ATVs and assumed that a competent salesman would be able to guide us through the process. We stated that we had a 400 lb pull-behind mower to pull. "*****" walked us thru the various models, looking at the tags on them. This 400cc model tag said it could pull 800 lbs, so "*****" said it should do the job. We noticed one had a snow blade attached and asked about that, with the potential of adding that on. He fully convinced us that this model would work. Never did he say that he would NOT recommend this model. We left the establishment and talked about it and researched for a week and returned on the following Saturday to do the purchase. Why would this business SELL us a snow blade (made for the unit) if it could not actually push snow? Or advertise on the tag that it could pull 800 lbs?-"In the colder months a battery tender should always be put on the battery". We DID have one on it, as it would never start up from the beginning of Sept 2021 until we brought it in for repair in Dec 2021 ( and tried to get it in the beginning of Nov 2021 but was told they had no room for it until Dec 2021) Even bought a brand new battery ($179) and put it on it with the battery charger.-""Assuming it was one of her employees put the sugar in their gas tank". This is the most vile statement of all. We have no "employees" and never told them we did. It is my wife and myself and an 8 acre horse farm. There was absolutely nobody in our circle that would do such a thing. The ATV kept stalling from day one on delivery. Something was very wrong with the unit from the first day it was delivered to us. BTW - ***** delivered it "free of charge" because he said he was going to be driving nearby and said no problem.-"Although it was not under warranty, out of the goodness of the owners heart" - YES, it WAS under warranty until June 2022.-"The owner said to take the part off another unit so we could get it fixed". This is false. I personally ASKED/PLEADED with them to take parts off another so we could get the ATV back, and was told that they could not do that because it would make another unit unsellable!-"The unit was completed March 26, 2022 but she didn't pick it up until the beginning of April 2022". It was being worked on Saturday afternoon March 26 and we had NO time available to hook up the trailer and get to their place before they closed for the weekend. We picked it up the following Saturday.-"We have not refused to switch the unit out". Yes, you have. We simply wanted a functioning ATV as this one had so many problems since day one. ***** was more than happy to sell us a much more expensive model. If you can't take this unit in to switch out, how do you "TAKE THE UNIT IN" to switch to a more expensive model? It was completely about the sale, not the customer service at this point._The manager said for her to bring the unit in to see what the issue was.....Mike said he left her a message and hasn't received a phone call back". Another false statement. I have NO missed phone calls since I called them on April 26, 2022. No voicemail messages, either.I now wish to completely terminate any more correspondence with this business, as they are completely unwilling to give us another similar unit. We are taking it to another ATV service center for repair and any future repairs.
