I received a bill from this company in the mail and I replied to the bill with a typed letter stating i needed proof as in payments, charges, eob from insurance and proof they are legally hired to pursue debt and to cease and desist all contact until they provide proof to which they did not. The letter was sent on Oct 6th and on Oct 22 they called my phone about this debt after they did not send proof. They are not to contact me until they can prove the debt

Fairway Capital Recovery did not receive a letter from this consumer.  First notice was mailed out on 9/4/24 to consumer home address.  Calls were made to the number on file from our client *** ***** ******** ********.  At that time we verbally spoke with the consumer and she asked for document to be mailed to home address on 10/21/24.  The itemized statement was mailed out to the consumer on 10/25/24.

I had some testing done with *** ******* ***** on 11/6/2023. An elective test that I did not authorize was completed without informing that it may require prior authorization from my insurance, or that it was in fact elective. Either of which would have been a reason for me to decline or postpone said test in order to contact my insurance before proceeding. I contacted *** ******* ***** about it, explaining what happened and disputed the portion of the bill that was charged in error. The lady in their billing department said that it was now resolved, and they had decided to "write it off" since I was charged in error, giving me the impression that this matter was now resolved on their end, as well as mine. Then, shortly thereafter, I receive a collection notice for $845 from Fairway Capital Recovery on behalf of *** ******* *****. I immediately requested validation of the debt as I already knew the matter was resolved, or so I thought. A. The debt was to be removed from the bill, per the billing department at *** ******* *****, as I did not give *** ******* ***** permission to move forward with elective tests that my insurance would not cover. B. The document Fairway Capital Recovery sent to me to validate a debt I was not even supposed to be billed, is dated May 3, 2024, six months AFTER the erroneous charge occurred.

Fairway Capital Recovery LLC continues to call and harass me multiple times a day regarding a “debt” to a company I have never been to. They refuse to show me proof that they have any knowledge that I’ve been to said company, and demand I pay them without even sending me any information to my email or via mail! The representative stated they “didn’t do that.”

      Business response

      05/10/2024

Fairway Capital Recovery has spoken with the above consumer multiple times concerning the debt in question.  The consumer had setup payments in August 2023 however the payments declined.  We have been in touch verbally to resolve the issue when the consumer requested a copy of the documents for this debt and wanted them mailed to home address.  When asked to validate the home address to send them to as we were informed we had the wrong address, the consumer hung up.  Fairway Capital Recovery will always provide validation of the debt whenever requested by a consumer.  Please see attached, and the consumer can contact ###-###-#### for further assistance.

I received a notice from Fairway Capital about a collection from *** and submitted information in November 2023 proving the amount in dispute was already dropped and dismissed by a different collection agency over a year ago. Fairway responded back in email showing information from *** as if that was proof of judgment. I responded back with more information to Fairway to back my own case and never heard back. This was in November 2023. I just received a notification on February 24,2023 that I now have a past due / derogatory on my credit report. I emailed Fairway and received a response that stating that the first email that showed the response from *** should have told me that I did not win dispute. It does not make sense to me that a claim dismissed by one collection agency can then be taken up by another collection agency. A consumer has no recourse and it is an unfair way to do business. Just because a business states a consumer owes an amount does not necessarily prove it. I provided several documents backing my claim of payments made and that it is simply students running a fraternity with records.

Thank you for the information.  The consumer was provided the documentation from our client *** ******** on 11/6/2023 validating the debt owed consisting of a signed contract and itemized statement.  *** ******** is a completely different entity, and completely different bill from ***.  *** ******** is also completely different from the Local Chapter and is not involved in billing by the local chapter.  Per ***, they did close the account on ***, but that is not *** ******** and what is being referred to in the ******* email attachment from ***.  The claim was not dismissed by ******* collections, it was cancelled and pulled by ***.  The consumer can contact our collections team at ###-###-#### for further assistance.

As per the letter I have attached I was billed twice. *** needs to adjust this billing. I realize that ******* does the billing. A business, *** cannot just bill twice and then say that a person owes that amount.  It is college students handling the billing and it was fine incorrectly, which is why letter is provided on this attachment.

The responses from Fairway and *** just keep going around and around. I see there are many many better business bureau complaints for the same exact reason. I do not owe this.. I was double billed. I have confirmation from letter sent as well as case dropped from collection agency one year ago. It is shady business practices.

Hello, I am writing to bring to your attention a concerning matter regarding Fairway Capital and their inaccurate reporting to credit bureaus, which has adversely affected my credit history. As a consumer, I am deeply troubled by the unjust practices that have led to this situation. Upon reviewing my credit report, I discovered that Fairway Capital has reported invalid information to the credit bureau, resulting in an inaccurate reflection of my creditworthiness. This erroneous reporting not only tarnishes my credit profile but also violates the laws governing fair credit reporting practices. In an attempt to rectify this issue, I contacted Fairway Capital to request validation of the debt they reported. However, I was met with uncooperative responses and was provided with no satisfactory information to substantiate the purported debt. Despite my efforts to resolve the matter directly, Fairway Capital has failed to address the concerns raised and continues to inaccurately report the debt to credit bureaus. I am reaching out to the Better Business Bureau in the hope that your esteemed organization can facilitate a resolution to this matter. I kindly request your assistance in compelling Fairway Capital to remove the invalid reporting from the credit bureau reports and to adhere to the laws and regulations governing fair credit reporting practices. It is my belief that by intervening in this dispute, the Better Business Bureau can help uphold consumer rights and ensure fair and accurate reporting practices within the credit industry. I am hopeful that your intervention will lead to a swift and satisfactory resolution of this issue. Thank you for your attention to this matter. I look forward to your prompt response and assistance in resolving this dispute. Sincerely, ******** ******
