      I decided recently to proceed with a bankruptcy filing. I went to this firm several years ago and started the filing but never completed it. I was told ANY AND ALL PAYMENTS MADE WOULD COUNT TOWARD MY FILING. I am now being told I have to prove those payments were made and when. If I have a file with their office..why do I have to prove payments? Why aren't they entered and kept? That sounds wrong to me. Sometimes people take years to file bankruptcy. I feel as If they have totally dropped the ball and I have completed all this paperwork and now have to use another firm. I am livid!

      A review of our calendar, listing all appointments and payments received, going back to 2014 fails to show any appointment for you or any payments made by you.  A review of all emails dating back to 2008 fails to show any communications from you prior to 2024.  A review of all of our debit card payments likewise shows no transactions from you.

      You had no receipts or other documentation to assist use in trying to confirm the date of your prior appointment or the payments you indicate was paid.

      In spite of all of that, when you spoke with attorney Nicholas ******, he indicated we would credit you $400 even though there was no way to confirm the payment.  In the complaint you indicated you paid $300.  That is obviously the problem, we have no way of knowing which figure is correct or even if a payment was made.

      In order to resolve the issue Nicholas indicated you would be credited with $400 toward the $800 in attorney fees and pre-filing costs.  With the court filing fee being postponed and paid in three instalments after your case is filed.  Nicholas emailed you the instructions for all the documents you needed to prepare and gather.  Once gathered you needed to fax, scan/email or drop them off.  You need to pay either the remaining $400 or if you choose, the filing fee as well which would make the full payment $738.00.  We will then give you a payment code to take your first course.  Once you complete the course you need to call us for an appointment to review your bankruptcy documents prior to filing with the court.  From the time you make your payment, give us the documents and complete the computer course you are only a few days away from being filed.

      As previously indicated, we are willing to credit you $400 toward your bankruptcy, but without proof of payment we will not refund $300.

      I reached out to this company in reference to filling bankruptcy. Upon my first conversation with them, they gave me of brief description of the process and how much it would cost to perform the services. He then told me I would have to pay $800.00 for him to start. I paid the $800.00 on 09/26/2023. He stated he would then send over the contract for me to sign. The contract he sent had a higher amount on there then we discussed. He then sent over a new one. I never signed it. Upon waiting I did not like the reviews. I tried calling with additional questions the next day and the day after I was not able to get in touch with him. I reach out to friend that had done business with him in the pass and she gave me another contact number in which I was able to get InTouch with a secretary. I explained to her that I did not sign anything, and I would like a refund. She said that's fine we just need it writing. 10/6/2023 I send over that email and ask for a refund. Then I get call from the actual attorney trying to convince me to move forward. I respectfully declined. He stated checks would be mailed out on the 10/15/2023 and I will be getting my money in the form of a check. Weeks go by no check I called the secretary she claimed it was mailed; she would call him. Another week go by I call again she said someone forgot. I called again Oh it was mailed. I said I did not get it. Can I pick it up or can you do ACH return no we don't do that. Finaly, I get a call from the actual attorney a week ago saying they were closing their accounts out or something and it should be in the mail. Still No Check. I just want this chapter in life closed. We are all facing economic changes and it is unfair that I have to wait all this time for my $800.00 to be refunded to me.

      We have mailed two refund checks to debtor.  One on December 6, 2023.  When that had not cleared by December 22, 2024 I called the debtor and asked whether she was holding it or had deposited it.  She indicated she had not received it.  I mailed a second check to her on December 26th, 2023.  That check also has not cleared my account as of January 12, 2024..

      On January 11th, 2024 my paralegal left a message for debtor to come to our office and pick up a check on Friday, January 12th, 2024.  No one appeared or called.

      Don't know what else to do.  I am not going to continue mailing out checks to the address she has confirmed, just to have them not arrive.

      If she will call my offices and set up an appointment to come in, she can pick up the check or we would be happy to mail it to the BBB and let you guys get it to her.
