      On July 30 I have them half the amount of the project they cancelled 3 times finally the last cancel they asked me if I wanted my money back I said yes and have not received anything back I don't believe I should be paying if they did not do the work

      We were hired by this customer to install her driveway. I had a cancellation so I offered her the appointment, and unfortunately it rained that day. We re-scheduled her to another date on which it rained again, so the next available install date was a week out. I had already collected the deposit from this customer, and ordered materials. When I gave the courtesy  reminder prior to installation to make sure the vehicles were moved, she told me she was tired of waiting and had another contractor come do her installation. I asked her why they would do that because I already ordered the materials, and she told me she was tired of waiting and wanted her money back. At that time I informed her, we already ordered material and scheduled trucks, so she should have let me know that she was hiring someone else because it was too late for a refund. She became irate, but all of this is stated clearly in the contract she signed on 07/20/2024

      All Star Paving And Sealing LLC. Columbus. No mailing address. I gave the company a deposit of $1474 on 5/31 to redo driveway. Scheduled 7/8 -7/9 but the company rescheduled once not due to weather or equipment issues with less than 24 hr notice and then cancelled the rescheduled job, though they knew this impacted work my plumber was doing to bury a pipe. ****** *******, co-owner, said she’d give me back my deposit. She did not. The company has not responded since 7/11. No work was done. 5/21, I signed the contract 5/24, deposit 5/31 and scheduled the job for 7/8. 5/31 ****** said they had no other jobs planned for 7/8. 7/6 ****** called saying they may need to reschedule due to rain on day2. 7/7 weather confirmed no rain for job on 7/8 , 7/9. ****** said crew wanted to do paving/sealing on 7/8. My driveway was scheduled on 5/31. She rescheduled me to 7/11, which required me to coordinate with the plumber again. 7/10 ****** txtd that the crew needed to reschedule my job again. Via phone ****** said the crew wanted to do another job that day. They did not cancel due to weather or other valid reasons. Via text if I could get my deposit back this was becoming too stressful. I sent an email to the company email, putting in writing that I wanted my deposit back. Contract says both parties had the right to terminate the contract with written notice. ****** had said she would bring me my deposit on morning of 7/11. ******* ******, co-owner, emailed that I would not be getting my deposit back. After that via text and phone ****** told me I would get my deposit back, the company has given money back in the past. This did not happen. I heard from her 7/11 that she would call at noon. She did not. It's now 7/15 and ****** has not responded to me. I would prefer is to get my money back. Disability is a reason one can terminate the contract. I do have disabilities. I am on a fixed income from disability insurance. Company has other complaints provided below. 3 PDFS attached.

      I understand the frustration, and we still have you down for install. Nonetheless, the signed contract states cancellation may occur, however, in the event of cancellation a refund will not be issued. 

      With that being said, our validity for rescheduling may not be valid in your opinion to why you think we rescheduled. We complete 3 driveways a day, if we miss one day we are behind a week or more.

      Hello ***** and *******,

      I wanted to respond as well. ***** thank you for sending this email. 

      *******, I do appreciate you responded to the complaint on Wednesday. I did get the response you left on the complaint, but I am not satisfied with your response because:

      1) You say I am still in list of driveways to do, but I have had zero communication from your company since July 11.

      2) You all are the ones who actually cancelled on me. I had the job scheduled with you for over a month. You rescheduled on the original date with less than 24 hours and then cancelled on the rescheduled date, with less than 24 hours. No alternative date was offered to me. I told ****** when I hired you all the two main reasons I wanted to get a new driveway is because the current driveway that was asphalt is broken so much that it’s basically grass. I have little animals get in my engine and chew on wire, in part because I am parking over grass basically. I also told her I needed to get my Sumpump outdoor pipe buried by my plumber, as the water was started to go under my deck and in my basement. I need to figure out an alternative plan which I can’t do until I get the deposit back.

      3) ****** is a co-owner and I included documentation on the compliant that shows communication from ****** that I would get my deposit back and that you all have given deposits back for special circumstances.

      4) As far as me not thinking your reasons for not doing my job aren’t valid, I was going by what ****** told me (all in the documentation). 

      5) I appreciate you do 3 jobs a day. I can imagine that’s hard work. When you rescheduled and canceled, my plumber had to change a number of jobs. His team was going to work very on the day it was reschedule to get it done. I also had to cancel my lawn moving service when it was rescheduled, as the driveway is the entrance to my back yard. Others were impacted too. 

      6) I have not been treated well, I feel. I am allowed to have those feelings. I am disabled and on disability,  the amount of energy it took for me to schedule everything with you all and the plumber, was exhausting for me.  You may not understand that, but with the autoimmune conditions that I have I can do very little a day. Disability is a reason to void the contract according to your agreement. Stress impacts me in a physical way. I can have my doctor write a note if needed. 

      7) You all didn’t do any work. So, I don’t know why I can’t get my money back. Even in your letter of agreement it’s mentioned that sometimes customers may have additional charges, as you all may need to more than was expected etc. I get that. If you expect customers to be flexible, then I believe you should be flexible too. Not everything can be as simple as we don’t give back deposits. It’s never stated that deposits are not refundable. You didn’t follow through with the job, even if you all feel those reasons were valid, you didn’t do the job.

      8) Lastly, after the way I was treated and honestly ghosted me since July 11th, I don’t feel comfortable anymore with working with you all. I should have to call and reschedule when you canceled, plus ****** said she’d call and never did. I did try to reach out.  I am allowed to feel uncomfortable in working you all, even if you don’t understand that. I was very excited to have you do my driveway when I met ****** and talked to her, but that changed after this experience. 

      So please give me back my deposit. You’ve had that deposit for almost 2 months now.

      Unfortunately the contract that she has signed states that if contract is canceled, A refund is not permitted. However, we still are willing to complete the project, we are not against not completing the project for her. I feel the circumstances are more than what she is presenting.
