      My daughter purchased a gift card for me. I didn't want the services offered. So, I added money to the gift card, and gave it to my wife. She doesn't want any of the services either.  Therefore, I would like my money back.

      I am writing in response to the complaint filed with your office by ******* ******* concerning a gift card issued by our company,  Restore Hyper Wellness. We understand and respect the role of the Better Business Bureau in facilitating a fair and just resolution to consumer grievances, and appreciate the opportunity to present our position on this matter.


      The complaint in question revolves around a gift card that was purchased by Mr. ********* daughter and gifted to Mr. ******* over a year ago. Mr. ******* has recently contacted us requesting a cash refund for the value of the unused gift card that he received.


      Our policy regarding gift cards, in line with standard industry practice, is that they are non-refundable and cannot be exchanged for cash. This policy is in place to protect the integrity of gift card programs and to ensure compliance with applicable laws and regulations.


      Per the Ohio Gift Card Law we are not in violation.  I have included it here for your reference:


      Under Ohio’s Gift Card Act, most single-store gift cards, for which the merchant has received payment for the full monetary value, must not expire or be assessed fees within two years of the date the card was issued. Specifically, merchants cannot sell gift cards or gift certificates with an expiration date of less than two years from the date the gift card was issued (federal law extends this to five years, in many cases). If the gift card has no expiration date, it is valid until redeemed or replaced with a new gift card. Merchants may not charge service fees, dormancy fees, latency fees, administrative fees, or any fees that reduce the total amount of the gift card, within two years of the card being issued.


      We empathize with Mr. ******** situation, however, we must maintain consistency to ensure fairness and clarity for all our customers. It is important to note that Mr. ******** daughter purchased the gift card for him, it remains valid and can be used to purchase services at any of our locations. We encourage Mr. ******* to utilize the full value of the gift card for its intended purpose.


      We regret any inconvenience this may have caused Mr. ******* but we believe that our policy on gift cards is both fair, reasonable and consistent with industry standards. We remain committed to providing high-quality services to all our customers, and we hope that Mr. ******* will continue to patronize our business in the future.
