The projects started on June 2nd. The amount of the projects paid is $17,850. Four Seasons Lawn Care and Snow Removal was supposed to lay sod, create a walkway, fire pit seating area, build a firepit, pave under the swing structure, pave under the pavilion, set up 3 flower gardens with perennials and mulch on the left and right side of the house, fill in rocks around my 3 trees in front of my house, plant perennials, remove a bush and stump, fill in the bald rock areas in rock garden directly in front of my house, lift the shed in my back yard, place pavers in a uniformed manner front to back and left to right in a rectangle under the shed, place blocks on the pavers under the shed aligned with the supports so that the shed is lifted from possible water and sturdy, a concrete pad was to be poured in front of the shed. There is an attachment on this complaint to outline what is wrong with the projects. The business has not resolved the issue and has cut off all communication with us.

Response by ****** ***** to Four Seasons Lawn Care and Snow Removal Rebuttal

      1. I never wanted just grass work in my backyard. If Four Season Lawn Care and Snow Removal thought the project was just grass work in the backyard, that’s their mistake. I explained what I wanted.  It was supposed to include; leveling the backyard, planting grass, laying down a stone walkway and building a fire pit.

I initially thought about getting a quote for landscaping work like laying dirt and planting grass since they are not a hardscaping company.  However, Four Seasons Lawn Care and Snow Removal representative ***** mentioned that they have ***e all types of work that I described above and showed me photos of a stone walkway and other hardscaping jobs that he claimed that his company did. I trusted him and asked him to give me a quote including all of these jobs.

      2.  The previous contractor was for Tree and Stump removal.  They completed to our satisfaction those specific jobs. They completed no landscaping or hardscaping.

      3.  I wanted to have grass seed planted because it is more affordable than sod.  However, Four Seasons Lawn Care and Snow Removal representative ***** mentioned that sod would give an immediate green look and the cost would not be that much different. Since I wanted to use my backyard for the 4th of July, I agreed on using sod. The job was supposed to be completed prior to the 4th of July, but as of this complaint it still has not been completed.

      4.  The natural flagstones prior to Four Seasons Lawn Care and Snow Removal’s subpar workmanship were in perfect condition as can be shown with photo evidence.  Now, they are all destroyed and covered with concrete caused by Four Seasons Lawn Care and Snow Removal.

      5.  As previously mentioned, the natural flagstones were in perfect condition, Four Seasons Lawn Care and Snow Removal did not save any of them. The stones were stacked on the side of the back yard and the back porch. They just used the materials that were there.

      6.  The firepit was mentioned when Four Seasons Lawn Care and Snow Removal’s representative ***** visited my property to discuss the project on 06-01-2023. A fire pit kit was purchased on 06-07-2023 by Four Seasons Lawn Care and Snow Removal representative ***** from Lowes with evidence backed by text correspondence.

      7.  I’m not sure who ***, ***, or ***** is as no one associated with this project is named as such.  Maybe they are other unsatisfied clients and Four Seasons Lawn Care and Snow Removal is confused as to which unsatisfied client they are responding to.

      8.  During the course of the first project, Four Seasons Lawn Care and Snow Removal’s representative ***** said he could give a wonderful price on flower gardens on the sides of the house (previous vegetation not killed, no weed mat placed down). I did not ask for this project, he suggested it.

      9.  During the course of the first and the second project, Four Seasons Lawn Care and Snow Removal’s representative ***** said this is the last discount offer that he can give me.  Since he’s already out here for the jobs, which are filling rocks around the trees, filling the empty spots in the rock garden in front of my house, in addition to removing shrubs and roots.  Roots are still there; the rock garden still has empty spots.  I did not ask for that, he suggested it.

      10.  During the course of the first job, extra dirt was brought in causing water to run into my backyard shed. Four Seasons Lawn Care and Snow Removal’s representative ***** pointed out that the shed will be damaged and his company can lift the shed and place pavers in a uniform rectangle under the shed.  Then, he could also place the blocks under the shed to further lift and level the shed.  This was not ***e.  No pavers were ever used and Four Seasons Lawn Care and Snow Removal’s representative ***** placed unlevel stone under the shed.  It has now caused the shed to sway unsafely whenever anyone goes inside. He was also supposed to grade and place a concrete slab in front of the shed.  Instead of grading the area, he just smeared concrete directly on the dirt. The concrete is so thin in areas that dirt shows through the concrete which is not State of Ohio regulation, according to my research.

      11.  No financing was ever asked for. The final payment was withheld due to the job not being completed and workmanship was subpar at best. Four Seasons Lawn Care and Snow Removal was offered to complete the job to the original specification and then final payment will be given. If Four Seasons Lawn Care and Snow Removal did not possess the skill needed to do the job correctly, it was suggested for them to hire a contractor possessing the necessary skills at their expense.

      12.  The fourth project was not just putting stones underneath the shed and some concrete in front of it. The job was to lift the shed and place pavers in a uniform rectangle under the shed and then place the blocks on all the supports under the shed to further lift and level the shed away from the water, as previously mentioned.

      13.  Four Seasons Lawn Care and Snow Removal asked “{if we were not satisfied, then why did we continue to hire them for other jobs.”  The fact is this on ONE job spread into four phases and all projects were being worked on simultaneously. I could not stop Four Seasons Lawn Care and Snow Removal from starting the second, third and fourth phase, if we were not happy with the first since they were being worked on at the same time. Four Seasons Lawn Care and Snow Removal is lacking transparency in this response.

      14.  Clearly from the many text messages and phone calls, there were obvious concerns about the workmanship for the completion of our projects. There were two lists given to Four Seasons Lawn Care and Snow Removal’s representative ***** regarding all four phases of the project not being completed or ***e incorrectly. On August 18, Four Seasons Lawn Care and Snow Removal’s representative ***** sent a text message saying, “Whatever is wrong with the project, I’m going to get it taken care of once and for all”. There was a quick phone call on the 19th stating that Four Seasons Lawn Care and Snow Removal will come out to finish the work. There was no further contact until August 29th. We assumed that Four Seasons Lawn Care and Snow Removal had quit the project so we had other companies come and assess the work. Each company said the same thing - the work would need to be fully demolished and built again because it was ***e incorrectly and outside of the State of Ohio Code, according to my research and their expertise.

      15.  I did not request Four Seasons Lawn Care and Snow Removal to stop contact with us. I requested the job be completed, though they need to hire other professional contractors at their expense. My words verbatim were: “My family is starting to feel unsafe with your demand. Please stop contact unless you can provide professional hardscape staff to redo the entire job at your expense.” To which Four Seasons Lawn Care and Snow Removal’s representative ***** responded verbatim: “Wow I literally have not mad 1 demand. I ***'t know where all this is coming from, I was only expecting final payment. And was awhere of these false accusations. And I'm the one scared. You always tell me you had to go punch your punching bag I will have no more contact with you sir. Have a good day.”

      16.  Another point consumers need to be aware of from this company is that Four Seasons Lawn Care and Snow Removal representative ***** will say he is just a project manager and **** is the owner as he said to me.  Based on the Google reviews published, he also stated this to other customers.  However, ***** and **** are the same person.  His name is ******* *********** ******.

I’m gonna reply to the rejection and keep it brief the stones that *** ***** had in his yard where are use stones coming from the previous contractor that came out that were doing a job that he didn’t complete probably from the customer. The customer is always threatening the contractor as I noticed, he told us that the previous contractor came out. He punched them and knocked him out and then called the cops prior to starting the project 75% up with a customer just state it and that book he written is not true or should I say fabricated he stated to us can we use and save some of his stones he already took and chipped away of old mortar off of it we told him that we can use the stones The project that we have done was done properly and completely right if it wasn’t what person in their right mind will keep asking a contractor to do other projects in their home. If they’re not satisfied, we did a total of five projects the last project, customer and customer wife we’re arguing outside about him being broke and don’t have any more money 4 Seasons try to help him out and gave him some extra time to pay the final payment. Everything was completed He liked everything that we done. Otherwise we would’ve never did five more projects and the customers backyard. And around the property. customer has threaten me and coworkers of 4 Seasons bar as my name is ******* *********** ****** my fathers name is ******* ***** ****** that is ****. I am *****. I am the owner. I don’t know why that makes any difference. customer still owes 4 Seasons $1215.99. Some of their employees of 4 Seasons is scared to go back on the property to attempt to fix anything. I told the customer I will come back and fix anything that could possibly be wrong for once, and for all. But clearly there wasn’t anything wrong. Customer just ran out of cash and don’t want to pay

I am rejecting this response because: '

      Good morning/afternoon/evening ****,

There were no threats made against Four Seasons Lawn Care and Snow Removal or any of their employees. I am using the BBB and State of Ohio Attorney General’s office to settle this issue civilly.  Any claim of threat should have evidence.  Four Seasons Lawn Care and Snow Removal also said I physically assaulted another contractor and had the police come to my home.  I can prove with evidence that this account of fiction by Four Seasons Lawn Care and Snow Removal did not happen.

The $1,215.99 was withheld because the work was not finished and what has been done is not to my satisfaction.  I have told their representative, *****, that the funds will be rendered upon proper completion of the job which in my experience is standard practice.

In Four Seasons Lawn Care and Snow Removals’ response, their representative stated that they are afraid to come to my home to complete the project.  Due to the inconsistencies, false accusations and the subpar work done by Four Seasons, my family and I would prefer to settle this civilly and hire a licensed, bonded and insured contractor who specializes in hardscapes and stonework. Additionally, the current contractors employed by Four Seasons Lawn Care and Snow Removal lack the skills needed to do the job they were contracted to do.  We have given Four Seasons Lawn Care and Snow Removal many chances to correct the multitude of issues, but it is apparent they are unable to complete the job to my satisfaction. Four Seasons Lawn Care and Snow Removal would not be able to provide any evidence of their responses.  I have evidence to every claim I have made.  I will be pursuing legal action against Four Season Lawn Care and Snow Removal if this is not able to be settled through the BBB or Ohio AG’s Office.

      Thank you,

Subject: Complaint # ******** Response to business Four Seasons Lawn Care and Snow Removal
      *** ************************************* *************************************** *** *********************** ************************** ********************* ***********************

      Attention **** *******,

In the next statements, I will counter each fictitious point by Four Seasons Lawn Care and Snow Removal in chronological order.

First, the natural flagstones were in perfect condition.  There were no other contractors hired for hardscapes.  The contractor Four Seasons Lawn Care and Snow Removal is referring to was a tree and stump removal service.  The stones had no cement, concrete, or any other substance on them.  We have pictures taken prior to Four Seasons Lawn Care and Snow Removal’s work showing the stones lined up in multiple stacks along my fence line.   Four Seasons Lawn Care and Snow Removal is being dishonest.  They destroyed our property with their negligence and lack of skill.  They failed to show proof of their hardscape license and/or cement license as needed in the State of Ohio.  I should not have been used as their “on the job experiment.”

Second, I never threatened any contractor.  This is a feeble attempt to cover up their lack of professionalism and subpar work.  I have a wonderful relationship with the contractor they said I “punched.”  If needed, I am able to get a statement from that contractor.  The next point is saying the police were called.  There would be a call log and a report created that is public record.  I assure you that there has been no police interaction at my residence since I have lived here.  Four Seasons Lawn Care and Snow Removal says that their job is done “properly and completely.”  There is correspondence via text messaging stating that we have not been happy with their work beginning in June 2023.

Third, Four Seasons Lawn Care and Snow Removal said they did 5 jobs.  My checks say “Phase 1 to 4.”  A phase is a part of one project.  This was made clear to Four Seasons Lawn Care and Snow Removal before any work was started.  Four Seasons Lawn Care and Snow Removal is stating that one phase finished and the next was started.  All four phases ran simultaneously due to many factors like supply shortage, employee needing time off to tend to his family and other uncontrollable factors.  Poor workmanship is Four Seasons Lawn Care and Snow Removal responsibility to correct.  At no point could I have stopped the work.  I paid them to finish the job and their representative, *****, from Four Seasons Lawn Care and Snow Removal kept telling me they will fix it.  It has not been fixed.

Fourth, Four Seasons Lawn Care and Snow Removal said they witnessed my wife and I fighting over the project because I am “broke.”  This is an attack on my financial stability which I find completely unprofessional and uncalled for.  I told the Four Seasons Lawn Care and Snow Removal representative, *****, that I will not pay the $1,215.99 until and unless the job is done accurately and completely.  At the current stage, if we were to sell our home, the work done by Four Seasons Lawn Care and Snow Removal would need to be demolished.  It would not pass a home inspection due to unsafe portions of the work.  I have already paid $17,850.00.  The money remaining is a fraction of what I have already paid.

Lastly, I will not pay for a job that is incomplete and unsafe.  My request is for Four Seasons Lawn Care and Snow Removal to do the job correctly.  Since they do not possess the needed skills, my suggestion was for Four Seasons Lawn Care and Snow Removal to hire someone who can do the job correctly.  If neither of these options are feasible, I believe I am entitled to a reimbursement.  If Four Seasons Lawn Care and Snow Removal is not willing to outsource or hire qualified staff to finish this project to what was agreed upon, this claim should be closed andI will be pursuing legal action against Four Season Lawn Care and Snow Removal if this is not able to be settled through the BBB or Ohio AG’s Office.
