Paid $300 on 1-30-2020 for a bankruptcy filing. I had to submit more paperwork to start the process. All attempts I made to proceed were not answered or no calls returned. I thought Covid may have limited operating hours for the law firm. I spoke with someone in 2021 and asked for a refund and the lady said she would call me back, never followed up.

I received this BBB Complaint and was very confused as I have not heard from this client in almost a year.  Mr. ***** originally came into my office on December 10, 2019.  Mr. ***** hired my law office on January 30, 2020.  I did not hear from Mr. ***** until March 1, 2021 where he informed my assistant that he was no longer interested in Bankruptcy.  My assistant informed him to send our office something in writing requesting termination of representation.  My office did receive that termination after filing of this complaint and speaking with this client on January 10, 2022.  (Please see attachment) After speaking with this client, we have came to the conclusion that Mr. ***** was not calling my law office or any number associated with my law office, as he was calling an ex-employee's personal cellular telephone.  That number is xxxxxxxxx but does not belong to The Law Office of M Sean Cydrus, LLC.  That employee has not been with my office since February 28, 2020.  I have not received any messages from this client other than the one where he actually called my law office telephone number at ###-###-#### on March 1, 2021.  I have processed an invoice for work performed on his case and submitted the remaining to the client at his address provided.

I have not received the refund check yet.  Per the attorney it was sent out 13 days ago.
Also, this case could not have been billed for any work because we never gave any paperwork to work on.
Also, my phone records show me calling the regular office number as well during this time, with no answer.  Call their office number, you’ll see that no one answers or returns calls.

      Regards,

I am truly sorry that the customer rejected my last response.  I mailed the refund, along with a copy of the invoice and signed contract, on Monday, January 17, 2022.  We mailed it to an address this customer used around August 19, 2019, the time he came into my office for the free consultation.  That mail was returned to my office on January 31, 2022.  We resent that mail to a second address we had in his file on February 1, 2022.

My office policy is to start work on a file immediately upon when the client retains our office.  This client had a couple lawsuits filed against him and time was of the essence.  This client was giving creditors my name and telephone number for them to contact me regarding debt that he owed.  We received several telephone calls and received several letters from creditors regarding debt he owed.  We answered creditor telephone calls and responded to creditor letters upon receiving such.  This customer also gave us bills that he owed so we could prepare paperwork for filing of his bankruptcy.  Even though we did not complete the filing of his bankruptcy due to missing documents, we absolutely did do work on his case.  Per the signed contract, we bill for the hours that were completed in each case.  I am attaching the invoice to this response with his name and local court case numbers blocked out.

The office telephone number is transferred to my personal cellular telephone after normal work hours.  This client was calling a former employee's personal cellular telephone number who has not worked for The Law Office of M. Sean Cydrus, LLC since February 2020.  I do apologize that the former employee never notified this customer or my office that he was trying to get in contact with us.  We did not receive any emails or voicemail from this client except for the termination of representation dated January 10, 2022.  I take pride in answering all calls in a timely manner as I know how frustrating it could be.
