  I am writing regarding the services I agreed to procure from you on 30NOVEMBER2021. Our agreement (Appendix A) was for you to do a structural inspection on a potential attic remodel in my home and provide me a written structural report by December 16th, 2021 (Appendix A). To date, you have failed to deliver this report and have failed to respond to my numerous attempts to reach you between December 14th 2021 and January 1st, 2022 (Appendix A). Given the failure to deliver as promised and the complete lack of communication from you on status, you have breached our agreement and, as of today 1JANUARY2022, our agreement is null and void. Please destroy via shredding or incinerator the check I provided you and do not attempt to cash it. My bank has been informed to not honor this check moving forward. Should you attempt to cash said check, doing so will be considered fraudulent activity and will be reported to the proper authorities. At this time, given our contract has been voided due to your failure to deliver, there are no funds to be transferred between you or I (“Parties”) and I am not indebted to you in any way, shape, or form. I am extremely unhappy and dissatisfied with your failure to deliver and false-promises; I was hopeful we could partner on this project but given your lack of response and delivery, I am no longer interested in doing business with you. As a result, I have been forced to delay my project, find another engineer, and have sustained real financial harm due to your poor performance. However, in the interest of closure on his matter, I will not be pursuing damages or litigation against you for your breach of contact. Instead, I agree to simply cancel our arrangement and not do any further business with each other. Please consider this letter my final communication with you. Should you feel the need to contact me further, you may do so only via written form via Facsimile, Certified US Postal Mail and/or E-Mail.
