      Job was paid in full, $13,500, in January 2024. As seen in our attached Letter of Demand for services, since that time, we've been trying to get Dayton Deck and Fence to come out to fix poor work completed by them covered under a Lifetime Craftsmanship Warranty and complete services not finished in January of 2024 when final payment was rendered. Dayton Deck and Fence has repeatedly ignored our requests for services to be completed, disregarded the terms of our existing contract that provided us with a Lifetime Craftsmanship Warranty, also guaranteed covered to us by the owner, Jake Denniston, and his Director of Operations Colin, and ignored our Letter of Demand for Services and Construction Punchlist sent Certified Mail and received by Dayton Deck and Fence on 3 July 2024. As such, we had to get quotes from other construction contractors to fix the issues with our deck due to Dayton Deck and Fences poor craftsmanship and shoddy work. The total dollar amount for fixes totals $6,000 and thus we are requesting a refund of $6,000 to cover the costs to fix their errors.

      I signed a contract with Dayton Deck and Fence on 10/16/23. They were to tear down an existing second story deck and build a new composite deck with rainguard. I was originally told the deck would be completed in 6 weeks. The existing deck was torn off in 6 weeks and then no work was done for weeks. It has been 9 months and still going on. There are issues that need addressed and poorly done work that needs corrected. I asked the owner, Jake Denniston, to look at the issues. He said he would be out 6/24/24 but never showed up. On 6/25/24 his director of operations, Eryk Graham, sent a text at 5:58am stating that he would “be by today”. I informed him that I would be working and not available. He proceeded to text bomb me with threats and coercion, demanding $5500. I told him I would no longer deal with him due to his unprofessionalism and threats. I let the owner know that I did not appreciate this harassment and that I did not want this man on my property. The owner, Jake Denniston, said he would be out to look at the issues and I gave him options for times I was available. They did not give me a time until they were en route, 6/28. He agreed that every issue needed fixed. . At this time he also refused to install the rainguard, which is listed in the contract, stating that it wouldn’t be affordable for him. I reached out multiple people times over the next week and a half to get scheduled. I was ignored. After sending a message relaying that I had spoken with the attorney general and would be seeking legal counsel if the work was not scheduled and completed, I got a reply stating I was scheduled for July 18. On July 18 I received a text message from the office manager that the builder would not be coming, but he could come the following day IF I gave them $4000 of the final payment. I informed him that I have paid 75% of the total and would pay the remainder once the deck was finished. I have not heard from them since.

      I received and signed an estimate for a 16x20 deck and perimeter fence project on March 31, 2023, and paid a 50% up-front deposit of $15,000. I was immediately pressured by **** ********* to contact his bank seeking an expedited check clearing process in order to "confirm materials" for the project. The estimate included installation dates of 4/10 and an estimated completion of 4/21. I then proceed to complete an improvement application as required by my HOA, which was submitted April 5th and approved on April 12th. This cleared us to begin construction. Since that time, I've experienced the following timeline: May 19 Asked for update, was told "digging holes tomorrow" June 1 Workers dug holes for new footings June 6 **** arrives to spray paint outlines of the 16x20 structure June 12 **** informs me that the "county inspector wont approve" our permits because the documents were not "hand-drawn" June 19 I received photos of blueprints from **** ostensibly for county approval. June 21 Workers demolish the existing structure June 27 I asked for an update and was told they are "waiting on materials" July 3 Workers dig holes for new concrete footings July 14 I asked for an update and was told they would "be done by July 24, crew ready to go" July 18 Workers arrived and begin installing the perimeter fence. July 27 Asked for update, am told they are "waiting on an inspector" Aug 4 Asked for update, am told "inspector back monday, crew ready to go, $950 architect hired to facilitate the permit documents, etc." Aug 10 Asked for update, am told "waiting on inspection date" Aug 22 Workers arrive, begin framing and pouring concrete. Sept 9 Materials are delivered Sept 14 Asked for update (unable to travel) Sept 20 Asked for update (unable to travel) Sept 25 Asked for update (unable to travel) It's been 178 days since signing, and I only have some framing to show for it. I'd like this job finished, permitting completed, and do not wish to pay the remaining 50%.

      In 2021, I had Dayton Deck and Fence install a white vinyl privacy fence. In December of 2021 on a mild day, the fence was held open by a brick garden paver 20” long. The wind kicked up as I was about to close it. The latch slammed and broke the vinyl. I messaged and asked if they could fix it. He said it was covered. He said he could probably put a 2x4 in the gate where the latch is to enforce it. It just had the latch screwed into the hollow vinyl. In January I didn’t hear from him. I found out he had Covid. Not a problem, I understand. Then it kept being pushed back. He said he would fix it and that date would come and go. No response. I contacted him and said it is supposed to be nice this weekend can you fix it. He said he would put me on the schedule and then no call, no show. This has continued multiple times. The last attempt was March 4. He said he would be there at 2pm on March 5. No call, no show. I asked on March 12, and no response. I spent $10,000 on a fence for my three dogs and I cannot use my gate. It is currently barricaded with two metal trash cans and a wood pallet to make sure my dogs don’t get out.
