On 5/12/22 I entered into a demolition contract with Steve Rauch Inc for the demolition of the second home on our property. I was made aware we'd be given topsoil. But we got clay dirt with rocks which has made that yard nothing short of a sticky disaster. In addition we have two sinkholes forming. One small one holding water in the photos, and a large one by the foundation remnant. It's difficult to tell but it's well over a foot deep and worsening. (the foundation remnant was by the City of Kettering's order) The old existing driveway pad: Kettering ordered it to be tore out and replaced with a grassy area. SRI did this, but did not backfill the area. Leaving a clay substrate and turning the area into a wading pool upon rains The soil they gave us was based on primarily clay I'm estimating at least 9cu - 12cu yards will be needed to rectify this with proper top soil (not clay!) and to fill the holes in. This would also cover the area by around 2 inches with real top soil. As seen in the signed contract Rauch states "Grade site to promote drainage" and as seen this was an absolute failure. Also "Backfill basement to existing grades" again, this has failed. It's fair to say that some settling may occur and we expected that, but this was not how it was supposed to have gone. I tried repeatedly to contact SRI by email and other means and have been ignored. If no recourse, may pursue other meansBusiness response

Attached Is a copy of the contract with Mr. *******. The only area that we had backfilled was the basement area. The contract has no mention of top soli. Job was finished last year in June, 2022,

I am rejecting this response because:

Contract states "Backfill basement to existing grades" this grading job has horribly failed. Backfill = soil, right? Although we accounted for soil settling, we did not expect a sinkhole, even worse a low spot feeding water into said sinkhole. We feel this displays subpar work and negligence on behalf of Rausch
Contract states "Grade site to promote damage" One area is not draining due to poor grading. The water then flows to the sinkhole and creates a bigger debacle.
Contract states again: "Grade site to promote damage" The parking pad area is a lake during a rain. Because your guy took all the gravel out and failed to "Grade site to promote damage"
Bottom line up front, we will pursue this through other means. You ignoring us through phone calls and email is enough.
