      Upside replaced our roof in 2020. In 2021 our sunroom started leaking bad over a window in one spot. After several calls and emails to Nick and Mindy, they sent their head roofer out. After his inspection he told me the sunroom roof was put on wrong and needed replaced. Nick came out after 2 weeks, said his head roofer was wrong and that the roof was fine. That it was just an “ice dam” and would never happen again. Then went on trying to sell us a heating unit may help but should not happen again but never really addressing the issue at hand. We also questioned several gutters that were never put back up but Nick said “he didn’t know where we got the gutters from and his guys always put back everything. In Feb/22, contacted Nick and Mindy again w/ videos of it raining in our sunroom in a new spot. Nick comes out and goes on to say he’s been doing roofing for years and has never seen anything like this. Said he would have his crew come out, replace the sunroom roof once the weather warmed up if that made us happy and would send out another guy to re-paint the damaged areas in the sunroom (because he knew a guy). It is now April 2023 and the sunroom roof is now leaking in 2 new additional spots on the patio side. We have not heard from Nick, Mindy or any rep from Upside since the day he promised to fix the issue. Our sunroom now has damage that will needs to be addressed due to the excessive water damage. The broken promises are not very business-like and the lack luster workmanship is very unprofessional. We have given Nick ample time to get things done but he along w/his company failed.

      First and for most we will contact The ******* to address the issue further .  We have not heard anything since our last visit.  Since then we have had another winter since etc and multiple scenarios where if it was a problem with the roof itself then it would leak all the time.  It has been determined the roof and room in question is and was built as a sun room/3 season room therefore the insulation and overhangs are not sufficient to building code requirements for year around use of this particular roof which given all those factors it is susceptible to Ice Damns which nobody guarantees against.  All roofs are susceptible to Ice Damns but this roof over the sunroom is even more so being it wasn't designed to be heated year around.

      I am rejecting this response because: our sunroom is NOT an addition to our home. It was built w/the house in 1994 and the roof never leaked before Upside touching it. Our housing division has several other homes w/the exact same layout as our (directly across the street). Nick even mentioned to my husband that “they” (Upside) only did the minimum flashing on the sunroof hence the reason that he was having his crew come out and re-do the sunroom roof. We are STILL waiting on a call, text, email, postal letter, or any kind of response from Nick, Mindy or Upside since 2022 when he promised to replace the roof. Also “Ice Dams” do not occur in April when there has been zero presence of ice or snow and with temps of 65-75 degrees.  I know Nick likes to use this excuse to shift the blame abut it is raining in our sunroom right now and the date is 4/19/23. No snow or ice so no ice dam. It is 69 degrees and sunny.

      Upside Roofing did no repairs to my roof back in September 2020, prior to Co-vid 19. I gave Nick F******..(************* ******r of Upside Roofing), a down payment of $3200.00. in a cashier's check from *** bank on September 10, 2020. Check # *******. My proposal was accepted on November 5, 2020. I received an email from Regan B**** (****** ******* for Upside Roofing) on March 15, 2021. "Scheduling for roof repairs would begin on April 1, 2021." No repairs were ever performed by Upside Roofing to date. (March 15, 2023).

      First and foremost we will reach out to ****** and address his concerns .  Due to the timing of this project going into winter and then covid it was a challenging time .  Given the circumstances of this project and situations surrounding it ****** will be offered a couple different options even though 20% of services were already rendered in the time spent and settling of his insurance claim therefore if he does not want the remainder of services to be rendered then he will be due a $1,347.77 Refund .  This Claim was to be Supplemented and I believe we had trouble getting it supplemented.  If ****** chooses to move forward with the project then Time Frames will be set and roughly $2,000 would be due on day work is majority complete.

      I am rejecting this response because:  Mr. F*****, has held this downpayment of $3,200.00 since 9-11-2020. This has been 31 months. I don't feel that his response is accurate regarding the amount of money, $1,850.00, that I owe him. No physical repairs to my property. I would be willing to give Mr. F***** $ 100.00 for assisting the appraiser of the claim on 8-28-2020. This would leave a balance of $ 3,100.00 to be refunded back. This claim has expired and is closed permanently by Nationwide Insurance on 3-1-2022. No funds are available for future repairs on this claim. (4-11-2023) Thank you.
