We deposited $10,000.00 with Dutch Legacy for the construction of a home. We made it quite clear that we wanted to start construction before month of December and we were told that was not a problem. We were told the prelimary drawings would be available in 1 to 1 1/2 weeks time. 2 weeks passed and I made a call the ***** asking where the drawings were and was told he had not heard anything yet. Approximately 1 week later we received a message that the drawings were available for us to view. Upon meeting with ***** we expressed concern with the layout of the kitchen and wanted to have some changes made. We were told that he could show us a different layout, but was out of the brochures and he would get back with us with another option. This was the last we heard from him. Realizing too much time had passed to meet our construction deadline, paying weekly penalty payments to the bank to hold our interest rate on our construction loan, we asked for a refund on our deposit so we could begin the search for a new builder. ***** never returned our phone calls, texts or emails. He made no attempt to come to a resolution.Customer response

To Whom It May Concern,
We are responding to Complaint ******** reported by *** * ***** ******* against our business Dutch Legacy Homes.
We are being reported as receiving a $10,000.00 deposit from the ********' which is initially required to begin the drafting of their home, preparing contracts, drawing plans, etc. which we did receive on 10/13/22.
It is clearly verbally communicated to ALL clients that this deposit is NONREFUNDABLE and I have enclosed a copy of our Deposit Acknowledgement Form that both *** * ******** signed on 10/13/22 which clearly outlines, by their signatures, that they were fully aware that this deposit was nonrefundable.
We expect that this will clearly appeal their allegations of business misconduct and that all reporting of such will be removed from our Business profiles with the Better Business Bureau. Should anything further be needed, please contact us by email or office phone above.Customer response

I have reviewed the response made by the business in reference to complaint ID ********* and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
Dutch Legacy Homes were given a deposit of $10,000.00 to begin the process of constructing our residential home. We were told, due to the time line we gave the builder, the plans would be available for review in 1 to 1 1/2 weeks. At 2 weeks we contacted Dutch Legacy and asked when the drawings would be available. ***** *esponded he did not know as he had not been contacted by his draftsman. Once the prelimary drawings were available to view, they were not to our satisfaction. We expressed concern over the size of the door openings and the kitchen layout was not as we would like. We requested revisions to the kitchen and door openings. We were given a contract to review at the conclusion of that meeting. We informed ***** we would have our legal counsel review the contract as we waited for the revisions to be made to the plans. We never received any further communication from ******
Dutch Legacy Homes should be responsible and refund the deposit made on a construction project they were obviously not prepared to service in a timely manner.
We have also filed a complaint with the **** ******** ********* office as these unreputable contractors must be stopped.
