      My mother is 83 years old. She hired Camargo Kitchen and Bath to remodel her bathroom. She gave him a check For $5,000 on 3/10/22. It was a 50% deposit on a $10,000 remodel. He told her that he wouldn't be able to get to it for a month or two. She said that was fine. She started calling him in May asking when he was going to start working on her bathroom. She was getting her bathtub replaced with a shower so that it would be easier for her to get in and out to take a shower. She fell several times because she has difficulty raising her legs. Greg D***** kept putting her off or not return calls. I called him (***** *********), my sister called him, and my mom kept calling him. Her health has been deteriorating and she is now living in ******* at an assisted living facility. Mr. D***** finally agreed to refund her on 8/12/22. He was supposed to bring her a check on the morning of Saturday, 8/13/22 the morning of her flight. He showed up without a check and just walked around her condo looking at stuff. She would be willing to take a $500 restock fee applied against the $5,000. But I'm not sure that she should even have to do that. He just kept stringing her along and as far as I'm concerned, he's a con man and a thief. I'm acing on her behalf as her POA. I'm hoping that we can get some assistance from you. One of the reasons he was selected was his rating with BBB. *** **** by ******** ********* POA

      Dear *** ****, 

      when I sold you the job I explained that I had

      exceptionally long lead times. You agreed that

      that would not be a problem. One week before 

      we were to start your project you called me to 

      tell me that you were moving in one week and I 

      had to do the project  right now . I told you we

      were starting the following week and you said 

      that would not work. I offered to complete the 

      work once you moved  and would be better for

      you as it was your only bathroom. I have personally

      visited with you to try to work out a schedule. I explained 

      I had purchased the materials and had the workers

      lined up for that next week. I would have been able to work

      with you if I could have gotten 30 days notice

      of your departure. You accused me of stealing your money

      and slandering my good name as you breached our 

      contract. I personally visited you at your home to try to 

      work out a schedule . One week notice  to cancel is not sufficient notice.

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, reasons for rejection are included below.  No refund was given.  Mr. D***** believes you can just accept a $ 5,000 deposit and never do the work.  Apparently he believes you can just keep putting people off indefinitely.

      We don't have a copy of the invoice or contract. All we have is the check.  My mom moved to ******* and is currently hospitalized.  The check is all I can provide for now.

      Camargo Kitchens entered into contract on 3/9/2022. It was explained to **** **** that my backlog was well into the summer.

      She agreed that that should not be a problem.  She wrote a check for $5000.00 that was to be used to hold her spot and 

      purchase materials. When we called to schedule the remodel, **** **** said that she was moving in one week and we had

      to do the work before she moved. I explained I could not drop everything and start her project. I agreed to meet with her

      to figure out when we could do the work. The condo was to be empty and I told her that would be a good time to do it

      before the sale of the condo. She stated that I was trying to steal her money because I would not agree to refund her money.

      I told her that because she gave mo notice of her departure it did not give me time to secure another project. I did not

      agree to give back any money at any time.

      Better Business Bureau:

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, reasons for rejection are included below.

      I was not informed that there would be a six month delay in starting the project

      Several calls were made each month starting in May, when the job was supposed to begin

      He agreed to refund the deposit and showed up the morning of the move, supposedly to drop off a check.  He was on a speaker phone and there were witnesses.

      According to **** Consumer Laws, he should have offered me a refund due to the delay in starting the project.  He never did any work at all.

      He will be getting a lawsuit filed against him if he doesn't refund the deposit.
