I’m a disabled vet, pushing 70 years old and for this guy, Peter P*******, the owner, who is supposedly a vet also, and for him to do this to me, shows he’s a bum, a fraud and has no morals. Peter came to my home after I made it known the grade of the driveway was extremely wrong, causing water to pond up against my home. When he came by, he didn't introduce himself, just stared at me, looking like I was the problem, very intimidating looking, like he wanted to beat me up. After I told Peter you can actually watch the ponding water drain between the joints of the asphalt and concrete and see it drain underneath new sidewalk, new concrete garage floor and garage footers he realized he was at fault, and said, **** IT! I'll rip the driveway out and just got in his truck and left. Me not knowing anything other than he was ripping the drive out made me email his secretary Katie. Her email reply is shown below stating it was Titan Asphalt fault and would replace it with no cost to me. Email from Titan sent On July 27th, 2023 ---- “”I apologize if you felt he had an attitude. He has a lot on his plate and he was going off what his crew told him they needed to do and what the situation was with the drive. So he was expecting to see something else. He, like most people do not like to get yelled at so I am sure everyone was on edge. This is not your fault. Pete told me Titan will come back out and rip out the driveway and replace it making sure to correct the grade with the proper flow. He will explain to the crew about making sure it has proper flow this time. We will do this at no cost. This is our mistake he told me and the only way to fix it is to rip it out and start from scratch again. I will not send the crew out without speaking to you about the new dates we will come to do the work. I will need to give what options I hav e available to get done. I am backed up on the schedule for next couple weeks but I can let you know what I have available.”” __

We also received a complaint through the Ohio Attorney Generals office and I attached the letter response I sent to them in regards to this customer.

The owner did take the time to meet the customer on site to discuss the situation and they customer was not being nice in any way. After trying to discuss the job the owner/Pete ended up walking away since customer was being argumentative and conversation was not getting anywhere. Here is also a picture shortly after rain, where you can tell the ground is still wet and there is no standing water what so ever so the water disbursing at a timely manner.

Let me know if you need anything else from us. Thank you.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

On July 10, 2023, Titan Asphalt & Paving began work on a new asphalt driveway for my home for the total amount of $7,198.00.

At the start of work, I made it clear to Titan’s crew members at least four (4) separate times about the grade of driveway for water flow to flow away from home. Something, nobody should have to tell any experienced construction crew. Any one with half a brain would have known to make the grade take the water flow away from home.

On July 17, 2023, the job was finished and Titan Asphalt was paid the full amount of $7,198.00.

On July 20, 2023, plaintiff sent Titan’s secretary, Katie, an email with an attached picture of water slowly draining from a garden hose down the center of garage door and driveway, showing the water flowing towards my home, ponding at foundation and sidewalks leading to the side man door. In addition, to several more pictures taken in heavy rain, showing the same ponding.

Whereas, the ponding water slowly drains down between and underneath the joints of asphalt and new concrete garage floor and sidewalks. It takes approximately ten (10) minutes after a heavy rain for ponding water to drain dry. In this email. I ask in several emails over a 7 day period if she/Katie could have Peter stop over to look at the grade of the driveway.

On July 27, 2023, Peter stopped by, he never introduce himself, just stared at me, making me feel uncomfortable and like I was the problem, a very large intimidating individual, especially, me being crippled and in a wheelchair.

After I told Peter about the ponding water and how you can actually watch the water drain down between the joints of the asphalt and concrete, right underneath my new sidewalks, new concrete garage floor and garage footers. He appeared mad when realizing he was at fault, and said, **** it! I'll rip the driveway out and just got in his truck and left.

Leaving me not knowing anything other than he was ripping the drive out. This caused me send an email to his secretary, Katie on July 27, 2023, time stamped, 2:06 PM.

In Katie’s email reply, dated July 27th, 2023, time stamped, 2:17 PM. She states Peter had admitted it was not my fault, but, his fault and that he would replace the driveway at no cost to me.

Then on Aug. 1, 2023, I received an email from Katie, stating Peter came out (one (1) hour) after a two (2) inch rain and determined there was nothing wrong with the driveway, further stating, Peter was not going to replace the driveway.

I paid Titan the full amount owed on the day the job was completed. Titan requires a $1,500 down payment and the balance due in 30 days after job completion.  I believe, Peter, the owner, did not know there was no balance owed and when he found this out 5 days later, that's what made him change his mind.

      Regards,

      ***** ********

I take an issue with Titan’s response saying I was angry and hollering at Peter when he came by to look at his mistakes with the grade of driveway. This is a deliberate lie! First, I'm a senior crippled with multiple sclerosis and Peter was paid in full and I was at his mercy for any compensation on driveway.

When Peter came over, he was the one with an aditude and anger,  I was in no position to argue with this giant of a man, especially, since I was wheelchair bound and had paid him in full, putting me at his mercy. On top of me emailing his secretary, Katie, right after Peter stormed away, informing her of Peter’s aditude.

Attached is a screenshot of a review posted on Angie list. If you read, this person encountered the same type of behavior from Peter as I did. Saying Peter was nasty rude, threatening and mean and refused to take care of his problems

      Regards,

      ***** ********
