      The company did a large landscaping job and elected to saw through some tree roots on two large trees. They have died and have to be removed. I let the contractors know at the time. I thought that was a mistake, but they hadn’t planned ahead for a waterline and sawed through the tree roots anyway. the owner came out and said he could help and decided since that time he would not. You cannot grow 50 year-old oak trees overnight and even though I got a very reasonable estimate for their removal 1800+ tax he is not even paying for them. I could go on a detail about a number of inadequacies with this Fast talking owner And the work they did, but I won’t. I have had two arborist out that have concluded that they killed those trees and h and m will do nothing about it.

      I was made aware that two trees had died  over 2 years from our installation of a vary large project in their back yard. This project include excavation, grade adjustments and even an open air pavilion attached to the back of their house. When i was made aware of the issue i personnel went out to look at the issue. At that time i did notice that two trees that were in the rear of the disturbance area had died. What i was shocked with was the other two larger trees [same variety of tree] we still fine and vibrant looking unaffected by the work. The two trees that had the most disruption did not die but two that were on the rear of the project did die. The customer is correct we did have to cut some roots to install the irrigation system we installed. We have done this on hundreds of jobs sites and have not had anything like this happen before. The only way to avoid disturbing some of the roots on the tree was to not install the irrigation system which the customer was passionate about because they didn't want to hand water the back yard. the space between the trees and the out building was less than 10'. Our staff didn't go right next to the trees by stayed as far away as they could and not hitting the building. i also want to acknowledge the customer failed to mention we had other issues on the project that we fixed and stood behind our warranty when the customer brought ups some items they were not happy about. Some items were subjective and we could have not changed them, but because we our a customer service oriented company so we took the high ground and fixed ALL of their issues. I feel bad that the trees died but i cant say that what we did killed the trees and to be honest we had to do our job and i don't think their was an neglect installing the irrigation system. That's why i wanted to visit the site 2 years after the projection completion so i could make do what i thought was best for the customer.

      Those trees were perfectly healthy for 50+ years before you cut their roots. You should’ve installed the sprinkler system up closer to the house and planned the job better I would have never consented to those tree roots being cut. Your lack of planning was the problem other examples could be cited there are no awards being given for simply visiting a customer site to see the damage you’ve done.

      Summer 2023 H&M installed stamped concrete patio, irrigation, and landscaping. Spring 2024, 9 months later, the patio had a huge crack, color was chipping, irrigation had multiple kinks and wasn't even connected in one bed causing multiple plants to die. Contacted project manager Mark ****** in April he kept pushing us off finally in August he had someone fill the crack with epoxy which we told him was unacceptable. Contacted the President Mark ******** who came out looked at the patio and said "it's beautiful I've seen much worse" and walked away. Called him and asked what he was going to do about the crack, chipping color, irrigation which we had to replace and pay for, and the landscaping and he said "nothing". We spent all this money and then some to fix issues and H&M takes no responsibility for the poor quality and workmanship.

      I personally stopped out at his house to review his concerns. At the time i stopped i noticed one hair line crack across the 4' walkway. The crack was less than a 16th of an inch wide. I explained that unfortunately concrete cracks. We did go out to the site and install silicone to seal the crack to make sure that water wouldn't cause the crack to get larger. As far as teh irrigation system goes. we were not aware of any issues on the system we installed. The description the customer gave me fit the application [drip irrigation] by time i visited the site the system had been changed from a drip irrigation to a pop up spray system. I asked if she had any pictures i couldn't  review and she said she did not. I couldn't help her with the irrigation becuase the new system they installed was totally different that the one we installed and i had no reference to look at.her concerns

      H&M has provided no resolution to our issues.  I have attached photos of the crack and of the chipping of the patio.  As you can see it's no "hairline" crack as they claim.  Further they made no mention of the color chipping in their response.  As far as the irrigation we needed to make a change as our landscaping was being destroyed!  Based on the lack of response from H&M we couldn't afford to wait for them to come out and look at it.  

      We again ask for the crack to be removed and monetary reimbursement for the irrigation and the plants that died as a result of their poor workmanship.  The project manager made unfilled promises of having the cracked section of the patio repoured all summer long and never delivered.  We have text messages we could send to support this claim.

      i have for your convenience attached the terms and conditions of the agreement signed by the customer. It clearly states we can be responsible for cracking or the release color in the concrete. it unfortunate  but concrete cracks and weather can cause the release to spall.  This is a normal reaction of concrete as it ages. The patio and walkway is almost 1,000 sq ft the customer needs to understand that there is going to be some flaws over time and like i said 99% of thsi patio is fine it has some weather which happens over time. i personally visited the site to put my own eyes on the project and in my professional expereince this project looks amazing. i would not hesitate to bring a future customer to show them this patio.

      July 26 we signed a contract to put a covered patio addition and use composite on the floor. The price came to about $80,000 when we signed the contract they wanted a deposit of $14,000. I don’t usually do that but I knew H&M landscaping and they have been in the area as long as we have and we have some family connection to his brothers. After much going back-and-forth with our HOA as we live in a condo they finally denied us the addition and we have a letter from Carlisle management saying that they denied us. When we signed the contract. I made sure to have in the contract, a statement that said if we did not get approval from the HOA, he would give us our deposit back. So when we sent the letter over in the contract to H&M the letter being the one we got from the HOA denying us. They sent us a letter saying that they usually take a 45% cancellation fee and they’re being real nice because they’re only going to keep her 14,000 and we have till April 1 to sign back up again if they kept the 14,000 would go to charge the job and if we don’t tell them by April 1 then we lose the money. But the contract clearly states that if the Hoa denied us then, we get our money back he’s trying to say that it was our decision not to go forward which is not true. I contacted him early this week I believe Tuesday which was October 3 and told him that we need our deposit back and I did talk to him. He was trying to put words in my mouth that we were the ones that didn’t wanna go forward which would mean that I don’t get my deposit back and I told him repeatedly that the HOA didn’t approve us after much going back-and-forth and then we have a letter. And we have a contract that says will get our money back if the HOA doesn’t approve us, it’s pretty simple

      The customer that filed the complaint doesn’t have all her facts correct. She entered into an agreement with us and in the contract we put a clause that read if she was denied the ability to install the project I would refund her money. She did get a denial letter from her HOA. But it was a denial that she couldn’t install the project it was a denial she couldn’t install the back deck with out going in front of the board for a variance. The HOA board has been very needy asking for a lot of items that were in excess, but  we have given them everything they want. Then they ask for something else and after we supply it to them they again come back for more details. Its been a pretty prolong experience but we are getting closer t the finish line. When we were asked to submit for a variance she said she was tired of all the hoops they wee making us jump through. At the end of the day the project in the front yard that was part of the job is cleared for installation, the back yard project has to have a variance which we were putting together for the HOA. I even told her that ok if you really want to cancel the project I will get all the drawing time and project management time we have into it and subtract that from the deposit and refund you for the rest and she was opposed to that even though that was in the terms of the agreement. We are in a holding pattern until she make sup her mind to have us go for the variance or get a partial refund. I am happy to supply you with a copy of the agreement if you need it for your records.

      Mark M******* keeps trying to put words in my mouth so that he can get away without giving us our refund. His work was substandard. His drawings were substandard and that’s why we couldn’t get anything pasted from the Hoa.  You’ll see in the attachment that he’s trying to charge us four times for drawings that should’ve been done properly the first time the total for the drawings that he’s trying to charge us is $2350. The drawings were too small, he used drawings from another job that he thought he could get past here, and the other two were not correct either and it was supposed to be on scale paper. We have a letter from the HOA saying that they denied us, we have a contract that  said he would give us the money back.  His charges on the bill are absolutely bogus. They’re actually funny as they’re such made up charges. His person did not come out here six times. And when he did come out, it was a cost of doing business because we needed more details before we could go forward with the project.

      I wish we had checked further, because if you look at his reviews, he’s got many negative reviews and lawsuits in all counties Cuyahoga, Geauga, and Lake County’s. They are about contracts and money being returned.

      He’s been in court many many times open this, Has to hire an attorney, you would think he would learn.  

      Other contractors that we have talked to since then, say that this is what he does, and they looked at the charges that she was charging us, and agreed that it was bogus, made up charges.

      With the bogus charges that he’s giving us on the attachment, he’s really just stealing our money. This seems to be a way of how he does business. Very unfortunate.

      Responding to the complaint. I contacted the customer and offered them a partial refund. Based on the contract they signed we are entitled to cost incurred to set up for their project. We have over six visits to their house to discuss the installation process. I also have permit designs and HOA perspectives I had to put together For this project. These are not normal expenses. We only incurred these type of expenses once we sign a project. Therefore, per our contract, we are entitled to being compensated for cost and we incurred. The customer asked for me to send over those costs which I did, and she refused the amount . Once again, even though their project has not been disapproved. I have to do one more step to get the permit. I still was going to allow him to get out of the contract as long as I was compensated for the work that I did for their project.
