We hired Affordapro LLC with rep Matthew Q**** to put in a concrete patio, steps and railing for a total of $6500. The patio and steps were done but not the railing. At first Matthew said he was looking for a railing but couldn't find one. We even went to **** ***** and sent Matthew a picture of available railings that could be delivered within a week. Then nothing. For several months he would never respond to any text that was sent. Matthew's number is the same number as the phone listed for the company. He finally responded and said he would refund $150 for the labor to install the railing. He would not refund the price of the railing saying he never bought one. We already paid for the railing in our total purchase price of the patio job. We purchased a railing for $107 and we would like that refunded to us.Initial Complaint

On July 21 I hired AffordaPro Restoration to build a 6 ft. privacy fence on my property. Q**** requested and obtained a check for half of the quoted cost in the amount of $1997.50 dated 7/21/22. Despite the advertisement stating that AffordaPro would pull permits, handle homeowner's associations and make sure underground lines are located, Matt Q**** assured me that it would be faster if I applied for the permit. Q**** also stated several times that the process would only take 3 or 4 days. I researched and began the paperwork but was delayed a week waiting for Q**** to provide the license number (with a different company name.) I faxed the paperwork to Delaware's Planning Dept. on 8/10/22. On 8/26/22 **** ******, *********** *******, emailed me to supply site plan including property lines & measurements of the fence sections (my plot did not have enough detail,) and distance from the existing fence (which does not belong to me,) and noting that there must be a 3 ft. distance between an existing fence & my proposed fence if they are not tied together. The layout of the property does not support a 3 ft. distance. I called Q**** stating that the permit could not be approved because of the 3 ft. Q**** stated I did the permit wrong and that was not true, I was lying. I spoke with Ms. ****** who stated that Q****'s business had built a fence in my subdivision WITHOUT a permit. I requested my funds returned. I forwarded Ms. ******'s email. Q**** claims I lied. Now his story has changed & he has already bought supplies, & I don't get the money back. I volunteered to buy the supplies at his cost with proof, which he has refused. Now he claims that he might give me some money back minus supplies and man hours. He has been to house 2 times for a total of 2 hours. Q**** has not addressed Ms. ******'s email or statement, continuing to call me a liar and delusional. I have kept all emails and text messages. This complaint is absurd. The client needs to have the chain link fence removed and demanded we do the tear out and haul away and disposal of the existing fence for FREE. I told her there was no way we could do that we have to pay the labor and the disposal of said fence. She became irritated and yelling demanding it be free. We charge $7.00 a foot for tear out and haul away for this. I would discount it to $3.00 a foot to get the project completed but we can not do it for free.

Matt has missed the point and has misquoted me as well The new attachment might explain the issue better. Issue 1: The county wants a 3 ft. clear space between the NEIGHBOR'S chain link fence and my proposed wood privacy fence. The neighbor's chain link cannot be removed (per the neighbor.) Issue 2: There is only 7 ft. between the neighbor's chain link and my garage. Because of the concrete slab step from the garage side door, the privacy fence would be up against it OR on top of it, neighbor of which allow my gardener to get the lawnmower from the front to the back yards.
THAT is why Matt needs to refund the entire deposit,
As to the "demand of free fence removal," Matt stated that we would just remove all the chain link fence to which I responded, no we will not unless he was to offer it free to my neighbor. I repeated this every time Matt demanded we remove it and I pay for it. Even if it was free my neighbor has stated he would NEVER approve that (which I knew.)
The issue is that the 3 ft. distance is codified in Delaware law, which Matt has never admitted. He may not understand about the concrete slab platform at the garage side door. He never drew any plans or take photos, so perhaps he forgot. But my gardener MUST be able to move a lawn mower from the front to the back yards.
