      Contacted PG Excavating on 04/20 to inquire about quoting the following: Ground clearing and leveling of front and back yard Cutting out and laying sand for a pool Cutting out and placing a 15x20 concrete patio. 04/28: Received quote totaling approx $7800. 05/09: Asked for quote without the patio. 05/17: Received new quote totaling approx $6000. Advised that we would like to proceed with the first quote. We were advised it would be a few weeks out and a couple of days to complete. Sean asked for a screenshot of the original quote due to it being deleted when he requoted. I advised that I didn't have because the quote sent was link. He advised no biggie, he had it written down and would send a new one. I never received. 05/25: reached out to inquire when work would start. Received response that it had been a crazy couple of weeks and that he would keep in touch. 06/02: Reached out to advise that we would be on vacation 06/08 - 06/11 if they could make it out by then. Received a response that he did not know when he would be coming out but it would be after we got back. 06/27: Reached out to ask for an estimated timeframe. Received response that it would be the end of July. 07/20: Reached out to ask if we were still on track for the end of July. Received response on 07/25 advising that it would be the week after next. 08/09: Received a message advising that they would be there next week and if that worked for me. I responded yes. Did not show. 08/29: Received message advising they would be there tomorrow. 08/30: Work began 09/01: Work stopped 09/29: Reached out to inquire when they would be back to complete the work. I was advised they would be back on 10/02. 10/02: Work all completed except pouring of concrete patio. 10/11: Reached out about concrete. Received response that he forgot to call to get pricing. 10/12: Received price of $4500. Which would put us approx $2000 over original quote. Was also advised that it would not be able to be done until spring.

      The reason that *** **** actually wrote a complaint is because he simply doesn't want to pay his invoice for work that was completed. The scope of work was spelled out clearly in Est. 0452 on 4/28/2023 at the amt of $6,270. Nowhere in this estimate does it say anything about a concrete pad being installed. However *** **** brings up multiple times throughout his complaint about an original estimate that had been deleted, which would later be found and provided in the attachments, which is also because when he asked us to add and updated version adding CONCRETE PREP. which is a gravel pad for a potential concrete patio in the future should *** * **** **** choose to have done and the area would already be prepped. When I made the second estimate I simply added the concrete prep and then re sent the estimate # being 0452 also which really makes no difference since there was still no concrete on this estimate. *** **** obviously provided a copy of the estimate he claims was lost/deleted by my software, which was 5,700 NOT 7,800, 8,000, 6000 or any other numbers he came up with and also shows no concrete patio installation was included in original estimate. Neither the 1st nor the 2nd estimate say anything about a concrete patio being installed. There is also a txt from *** **** stating that he realized there was not patio in the original. Attached is copy of original estimate provided by *** **** he sent the BBB and the 2nd estimate, the invoice for the work performed, txt from *** **** admitting there was no patio in the original estimate, and a list of txt that I printed out that *** **** DID NOT provide the BBB with him stating he would be getting the bill taken care of, and with no issues at that time.  *** **** also tried to tailor his complaint of there being a timeline issue. There was never once a date for a deadline set nor, he mentions all the phone calls we had where I was told to wait until he talked to his wife before proceeding. He also left out that after we completed over half the job we had to stop for a few weeks to a month before finishing because *** **** had to spray and kill his yard so we graded his yard the final work would look much better. We simply sent *** **** an estimate, performed scope of work listed in both estimates, and provided and invoice for all work that was done and listed in estimate. *** **** and myself later talked about pricing for a concrete patio installation after we had completed the job we were there to do. This conversation about a concrete patio are also provided in our txt messages. He has twisted the facts and dates that he provided in his complaint, and I guess he felt that slandering and badmouthing our company that has never had one bad review whether its via BBB, Google, or Angi leads he thought it would get him out of paying his Invoice.

      I also forgot to explain why the invoice was less than the estimate and that because like it was stated in the txt between *** **** and myself there was no topsoil needed so we took off the amt for the topsoil

      I am rejecting this response because: This has nothing to do with the fact that I simply don't want to pay. I am more than happy to pay however, because the job was not completed and I now have to find someone to do the rest of the job, I should not have to pay anything above what was agreed upon based on the original quote that included the patio being poured.

      You can clearly see by the messages provided that he admits the initial estimate was "lost" and that he had it written down somewhere. The initial estimate had the yard, pool, and patio. It was not just "Concrete Prep" as stated in *** ******* response. It would make no sense to reach out in April to get all the work done and only do "Concrete Prep". You can clearly see per message between myself, my wife, and my mother-in-law that we were discussing having the patio removed from the initial estimate and ultimately decided to go with the original estimate which had the patio due to the price difference being so minor.

      There clearly was a timeline issue because again, it would make no sense to hire someone to do yard work with a pool prep and putting in a patio, in addition to asking for a timeline which is also clearly shown in text messages. In May I asked about how long it would take and was advised a couple of weeks out and a couple of days to complete. A couple of weeks turned into months and a couple of days turned into weeks. When they actually started the work in September, they completed the initial prep of the yard and advised me to spray to kill all the grass which I immediately did. I had to reach back out to them weeks later to see if they were coming back to finish up. All of this is also clearly shown in the messages provided. 

      *** ***** tried to indicate that concrete work was not discussed until after the prep work was completed. This does not line up with the conversation that is clearly shown in the initial conversation. It would also not make sense to hire someone to put in a patio, only get a prep quote, and then after the prep work was completed ask for a quote to finish the job.

      The dates and facts are clearly laid out in the messages provided. I do not need to twist facts or dates as it is clearly laid out. The only quote I have from 04/28/2023 was the second quote which had the patio removed. This is clearly stated and proven in the messages provided.

      Since the original quote was approximately $7800 and I budgeted $8000, I will hire someone to complete the job and pay them what is remaining out of the $8000.
