We rescued our dog from the humane society on August 21, 2021. When we rescued the dog we signed a contract with the humane society and within that contract there was a section that stated that if within 45 days of taking possession of the dog we noticed any health issues, to contact the humane society and they would arrange for the evaluation and treatment of our pet at no cost to us. We were informed of some health issues and contacted the humane society within that 45 days. They refused to honor the contract and provide the necessary veterinary care. We contacted them through a lawyer and they did not respond to the lawyer either.Business response

Business Response /* (1000, 5, 2021/12/01) */ Since 1985 we have placed many thousands of animals using this contract, which was, in fact, developed by an attorney, and provides that all animals placed are spayed/neutered, have all shots and deworming, are tested for heartworm and started on preventive, are treated for fleas/ticks as needed and are microchipped - all for $75. ** _____ is the only person to date to attempt to misconstrue the intent and meaning of the wording in the contract. He could have at any time in the first 45 days returned the animal for evaluation and possible treatment by our two full-time staff veterinarians. Our contract is two pages, the majority of which outlines required care standards. The second page is titled "About the Health of Your New Pet", and reads in part: "As far as we can tell, your pet appears to be in good health. Everything that has been given to or done for it is indicated below. It should also be noted that we may know nothing about the animal's history." "If, in the next 45 days, your new pet should become ill, or if you notice anything unusual, please call us. If necessary, we will arrange veterinary evaluation and treatment, and you will not be charged for their services or advice." He did not call us when he noticed anything unusual, but instead called us on the 44th day to advise his vet told him the dog had a heart arrhythmia and needed dental care, and **. ___ expected the shelter to pay for a cardiologist and for the dental treatment. The contract goes on: "Should you take the animal to your own vet, you are fully responsible for the bills." The rest of the contract lists all vet care the animal has received with us as well as handwritten notes from our vet clinic regarding any specific issues with the pet. In this case, veterinary notes state: "***** has 1 fractured canine. It does not appear to be bothering him. Monitor with your regular veterinarian." And, finally, the provision in our contract: "It is agreed that the Humane Society retains superior title to said animal including any microchip registries . . . " The entire contract was read to **. ____ so there could be no misunderstanding; and he agreed to each and every stipulation in that contract.
