      I seen an item for sale on there web site and I called and they said I could put it in layaway so I did the item priccc we was $1049 so they stayed I needed $250 down so I put the $250 down and there was no agreement or did I sighn no agreement the only thing that was stated I needed to have item paid off in 60 days of purchase so a few weeks later I took a drive to the ssid store and I was going there to pay more money on the layaway a got to the store I wanted to see the item in person so I looked at the item witch they stated to me that the item was new well it wasn’t new it had scratches on it and they said it was used a ssid no you told me it was new and I stated I wanted my $250 back and they said there was a 25% fee on return of layaway item well I was not aware of that nor was I told that on the phone nor did I sighn any contract stating that do they stole my money and I want it back

      Dear sir/madam 

      My name is Michael Y****, the owner of Bills Bait House. I am writing this letter  regarding the complaint files against us by ****** ********. On 8/24/2022 we received in a used  **** ****. We posted it on our ******** page but due to ******** regulations we only post  make and model with no prices or description. In the following days *** ******** contacted us  inquiring about purchasing said firearm with our lay away program. I Mike y**** spoke to ***  ******** about the **** **** when he called on 9/2/2022. I told him that it was a used firearm  several times throughout our conversation. *** ******** opted to place the firearm in lay away  with a $250.00 deposit over the phone. Per our lay away policy, we have all customers fill out a  lay away contract but because he was paying over the phone, he had not fill out the contract yet.  In the contract as well as posted in the store tit states that all lay away are subject to a 25%  restocking fee of total purchase price should the customer forfeit the purchase. *** ******** came  to our store on 9/24/2022 to look at and pay on the firearm. We got it out of the back for him and  as soon as he seen it, he started saying that was not the right firearm. He said that the firearm he  paid for was green and this one was blued.

      We then proceeded to pull up the ******** post to  show him that it was the same firearm. He accused us of lying about what firearm we put in the  back for him. We have never had a green 1911 in our store. After we denied his accusation that it  was not the right firearm, he then started saying how it was all scratched up. We left the post up  on our ******** page to show prof of color and quality of the firearm. After discussing with him  for serval minutes the condition of the firearm that was used and not scratched like he said he  then decided that he did not want it anymore. Even though it is in our policy that we keep the  25% down payment for a restocking fee we decided to give him 100$ of his money back. We  could not get him to sign the receipt of it. We kept the yellow copy and gave him a copy of it as  well. I believe that he had no intention when he got to our store of purchasing this firearm  because it was on excuse after another to get his money back after we held it for 3 weeks. After  refusing to sign the copy of the receipt he said that this happened to him at another local gun  shop called **** *** *******. He told us that he will be getting his money back and that we  will hear from him as he walked out.

      While reading his letter I seen where he said that we did  not give him any of his money back. We have it on camera of us giving him 100$ back and  giving him a receipt. I will attach a copy of the receipt, lay away contract, and the signs hanging  up in the store. I can bring in a copy of the video on a USB drive upon request.
