  We contracted with TJ Flooring for 2 separate jobs (bathroom & flooring). The bathroom job was to be completed first with the flooring job starting later. We paid a downpayment for each job. The bathroom job started on 12/5, and we were told it would be completed by 12/14. He got most of the job done on 12/18. At that time he demanded payment for the entirety of the bathroom job even though some items remained. The biggest issue was that the curb at the bottom of the shower needed to be completed. Without that done, we cannot have the shower door installed. Without the doors the shower is not functional. There are other items that remain {hanging lights and mirrors, filling holes in kick plate, adding cabinet molding, etc.). We were uncomfortable paying him in full when the job was not entirely complete. He complained that it was right before Christmas and he needed to pay his workers. He promised to be out 12/26 to finish the job. Against our better judgment, we paid him the full price remaining on the job ($5645). We have not see him since. We also told him at this time that we no longer wanted to do the flooring job and want the deposit of $3155.01 back. He said he would refund it in 30 days. He said that he was unable to show on 12/26 due to an issue at his home and would come out 1/2. On 1/2 he did not come out because he said he was behind on other jobs. He did send out his painter that week to do some fixes. The paint work was unsatisfactory and more needs to be done. Anthony next said he would be out on 1/9. He then changed that to today 1/13. Today he did not show and did not respond to our text messages. At this point we have 5 people using 1 shower because this shower isn't functional. The job was to be done a month ago. It is causing extreme inconvenience. At this point we want our 3155.01 back as well as compensation for the undone work that we paid on the bathroom job that wasn't completed as we now have to hire someone else to finish.

  Contract 1  Everything on written job scope completed. Anthony stated that his business completed additional work for which they have not been paid. Consumer wants business to complete additional items outside written contract.
  
  Contract 2  Deposit made of $3155.01. Anthony said that consumer breached contract in that they cancelled contract beyond three day right to cancel. Anthony stated that he is not in agreement to return the deposit.
