      I signed up to join a fitness program through Travis Garzas *************/*********** on 11/17/22. The program does not start until January 2023. On 11/29/22 I canceled my enrollment of this program and requested a refund for the program, in the amount of $447 and supplement package, in the amount of $217. The reason for the cancellation is due to a medical condition that I currently have that includes a mass on my brain and a cerebral blood flow issue that could result in me passing out during exercise. I explained all of this to the manager on 11/29/22, at which time, I was denied a refund and told that I could still benefit from the program mentally and emotionally. The manager understood that I could not exercise, which means I would not be able to use their facility, which is the bulk of the program costs and the bulk of their operational costs. The manager asked if I would like for her to see if she could get me a refund for the supplement package. I have not, nor would I ever receive the supplements since I canceled my enrollment, so it would only make sense and be fair if they issued a refund for items I paid for, but never received.I reached out again on 12/08/22 and explained my situation further, to make sure that they understood why I cannot participate in the program due to medical conditions. I have not received a response yet, but did receive a refund for the supplement package in the amount of $217.The current requested refund is for $447 for the fitness program that I cannot and have not utilized. I just simply want the $447 program fees refunded, as the program has not even started, nor have I gained any benefit.

      Before signing up for our program, it is required to attend an orientation/information meeting going over all aspects of the program. The mental, emotional, and physical aspects of the program are all a part of the discussion and included explanation of the program is FAR more than eat this and workout to lose weight and can find success in all other aspects of the program regardless of certain physical limitations. We have a dietary therapist on staff that helps guide and create the eating plan that was discussed in the complaint.During the orientation and on the program agreement form, which was signed by the customer on 11/17/2022, that there would be no refunds given for the program price. A health evaluation form was also completed and signed by the customer on the same evening. The customer has completed other programs and has filled out health evaluations in the past and makes the changes in health conditions easy to track. When the customer reached out to our office (11/29/22), the supplement package refund was offered immediately (11/30/22) but was delayed due to an untimely response (12/8/22) from the customer. After receiving the customers response, a refund was issued (12/13/22). Our manager offered to hold the amount of the program on account until the customer is released or feels more comfortable in participating and requested doctors documentation of the diagnosis and/or recommendation of no physical activity. As of 12/19/22 there has been zero correspondence from the customer since the last email was sent by our manager on 12/13/22. I have attached the program agreement and email correspondence.

      I am rejecting this response because: I will not provide a doctors note, as that will result in additional out of pocket expense for me as well as I have already provided more than enough information regarding my health issues. I have MRI results that reflect the issues I described, but should not have to provide this either. I also am not interested in placing my money on hold for a future challenge, as I am no longer interested in having any type of affiliation with Travis ***** *************, as I have been informed of horrible treatment of Travis Garzas employees, such as calling them names like Shamu and other discriminatory behavior witnessed by previous employees. I am again requesting all money to be refunded, as no service or product has been received by me. My next steps are to take this to a social media platform to inform current and future customers and to seek legal counsel. 
      I can provide more information, but this form has a time limit.

      We have processed a refund and request any and all negative reviews from social media/google (including the reviews from created accounts) stating the medical/personal information was not protected, to be removed. The ***** release that was signed through the BBB allows the business "*******" to use the clients information needed for resolution. In no way was the personal information ever at risk of being shared, making the reviews false (slander/defamation). It is unlawful for an individual to make statements that intend harm to a person's reputation without factual evidence or based on hearsay. Please cease and desist from making factually untrue statements and reviews from this point forward.
