      In sept 2021 I was charged $966.99 to my cc as a deposit for parts and service to repair my ebike. I pd by check $120 in aug of same Yr for diagnostics for a total of $1086.99. The service and parts were never completed. I was told multiple times by the owner that parts were back ordered or stuck on container ships near the port of ***********. Finally on Oct 10 2022 we mutually agreed to terminate the job with a charge of $77.50 for diagnostic work. The remaining $1009.49 was to be credited to my c.c. 30 days later I still did not have the credit and I made the Owner, *******************************, aware. He has still not resolved the discrepancy and is not taking my calls. He has had my money for more than 13 months and provided only incorrect information at best but more likely false information. I would very much like this resolved asap!

      We took in deposit for repair/parts. The parts we ordered where having manufacturing and shipping delays caused by Covid pandemic. After not being able to get parts needed we did both agree to do refund, on 10/10/22 we did a refund through our 3rd party credit card possessing and looked good, On our end it shows everything processed fine. the customer came in to shop to tell us he has not received refund, I told him it shows itd done and he would have to talk to his bank The customer got upset and left our shop slamming door causing damage to door. After customer left our store he then went into our local bank branch demanding that bank manger show him our accounts. The bank manger told the customer he cant talk about his clients information, after **** left bank , the bank manager waked over to tell me what has happened and planned to meet today(11/17/22) and figure out what's going on.   come to find out today(11/17/2022) at a meeting with out bank that our credit card processing equipment and or processing company software malfunctioned casing the refund to never fully be processed due to the equipment being outdated. We are working with the Bank/Credit card processing company to get this resolved. I called our customer and left voicemail also ********/**/22) to let him know we have figured out the problem and asked him to call us back. We have the credit processing company sending us documents needed show error. We also are waiting on outside video from property owner to show customer slamming our front door, ****** a quote from contractor on fixing damages. Once we are all set we will then show customer the quote on fixing damages and see if he would like to resolve by us re-processing original refund or put the money towards damages caused. Ultimately i would like to be able to reprocess refund and customer pay damages cost. if customer does not want to pay for damages caused we will then re-process refund and take customer to small claims court and deal with damages that way. We are sorry that this has to be sent to BBB, we were 100% upfront with info to customer other then not knowing processing equipment failed. I and Bandon Bicycle Works wants no hardship on anyone and hopes to resolve these matters with customer in a professional matter. Thanks.

      I am rejecting this response because: on tuesday 11/29 i visited the store and asked the owner how he intended to resolve the refund of $1009.49 and we agreed that he would provide me a check for the full amount and then he could file a small claims document to settle the door and sign damage that he claims I caused (Idid not see any significant damage) I then asked for the check and he said he didnt have checks and would need to walk around the corner to his bank to get a counter check but was not able to leave the store at that time. He told me he would have the check 2 days hence on 12/1 and he would call me. He did not call so I called his store, no answer so I left message that I was in town and would stop by for the promised check. Door was locked so I left. At this time he is not taking my calls and is avoiding me at the store and has still not refunded my deposit of $1009.49 owed to me because he did not perform the service or parts after more than 15 months.

      I am rejecting this response because: We cannot agree on the terms or amount of refund, I have repeatedly offered ways for us to come to a compromise, but the owner has not been willing to meet in the middle. His offer is to refund $450 of my $1009 deposit because of unsubstantiated and exaggerated claims of damage to a sign I may have caused leaving his store. Furthermore, I am reluctant to provide my address because of an email he sent me suggesting physical harm to me, my family, and our property.

      **** will not provide any address for me to send the remaining balance of his return to from the very start, he kept denying he did any damage, then admitted to it. He also said he has a history of it. He keeps giving excuses why he caused the damage including saying the reason he did the damage was because i made him act that way.. He also told a story about how his wife has medical issues causing lots of stress on him. **** thinks he can decide what our property is worth when I have the quotes to replace it, he keeps attempting to talk the damage down or accuse me of making the damage sound worse. I told him that I will include copies of the quotes and pics of the damaged property, but he refuses. During a past conversation i mentioned that the way he acts in public with his violent outbursts someday he could come across the wrong person unlike myself and harm himself or they might harm him or family, and that its not worth acting like that and should just take responsibility for his actions to better himself but most importantly so myself and business can move on from the continued stress caused and harassment from ***** I also said he should just get out and enjoy a nice bike ride and there are no hard feelings from me. All our conversations were over email so there is proof of that. **** has a victim personality and uncontrollable anger with violent outbursts. I had to tell him multiple times to stop harassing me and coming to my business, he went into my business bank attempting to get my business info and he contacted my landlord. I have statements from them as well. He keeps refusing to give me an address to send a check and has attempted to intimidate me with threats of suing, defamation of myself and business and trespassing. I don't care what address he gives, his home, po box, friends house, lawyers office or any other address he wants, just give an address so i can mail the remaining balance of his return with quotes and damage pics so i can move on with my business and personal life.

      I am rejecting this response because: The owner continues to suggest that he is trying to resolve but has refused to follow through with any attempts to remedy. I have been awarded a small claims judgement form Coos County signed by a Judge, please see attachment along with the demand letter. I sent the documents by certified **** letter including an address to send the refund, but the Owner refused delivery by the mail carrier. My next step is to involve the sheriff's **** to serve the notice. ******************************* has resisted earlier attempts to resolve and has been unwilling to cooperate every step of the way regardless of what he claims.
