      I contacted this construction company regarding several projects in late 2022. There was never a signed contract as we were discussing several projects. I had a deposit of $4,500 sent to them via an escrow company that was part of the sale of this property. They have done zero work in nine months. Zero! When I reached out to ask when the could get started I was told "next week" or "early next month." The last time I reached out (September 6, 2023) I said that if they were too busy to do the work that was fine, just please return the deposit. They refused.

      The company did eventually respond to my request and refunded my deposit in full. However, they did so reluctantly and only after attempting to cause problems for me.

      It's true the customer did ask for some work to be done. She asked for a new septic tank to be installed, then when the escrow company released the funds for it and we received it she wanted to switch it up and have us use the money to do some framing work with it. That money was only allowed to be used for the septic and that was relayed to both parties via email communication from the escrow company. The escrow company asked us via a phone call just before the money was released if this is what the money was going to be used for, all so I  answered yes. When I reminded the customer of this she told us it was no big deal. Also she asked us to lie to her buisness partner about the work as well and I have those emails to prove that. When we pulled out of the job we told her that we couldn't give her the money because it was sent to us by the escrow company and not her. So I asked our accountant and attorney to look into it and to see what we should do with the money. The escrow company declined to open the closed account and we were instructed by our council to refund the money to the next person in line. So I wrote a check and sent it to the former customer. But see if a contractor stands up and does the right thing they get smeared on line and no body knows the difference. You just can win.

      I received a full refund. However, the business has issued an inaccurate statement to the BBB that is now part of the record. Can I still respond to that?
